Bogus validation--should I sue?

    I've got 5 TVs in my office and more in other parts of the place and I watch the news most evenings and that's about it.

    RECAP AND UPDATE: This was a case I first reported to Creditnet in Feb 2003 of a CA trying to collect on two medical debts in amounts of $238 and $53. I first offered to pay them in full for a deletion, which they refused. I then tried a restrictive endorsement on one of the checks; they deposited my check but then refused to delete the account per the restrictive endorsement. In the process of my disputing these accounts, the CA committed various violations of the FDCPA and the FCRA. I subsequently sued.

    We are currently discussing settlement in the range of $4k including deletion of both accounts from my CR. I probably could have done better, but I'm not that great of a negotiator. If they require a confidentiality clause, there will be no further discussion of the final settlement amount.

    The key to getting settlements and/or deletions is to get your violations on record and also have some damages (real or imagined) you can threaten them with. They should have accepted my first offer to pay both accounts in full in exchange for deletions (and take an easy profit for the company), but that of course would be beneath the MORALS of any collection agency! The way I see it...serves them right for taking that attitude.
