Bounced check from 1993???

    I got a nice little surprise in the mail today. Some collection agency from NJ sent me a letter trying to collect on a bounced check from 1993. Apparently they also have a MA office. First of all I have no idea if I bounced a check. My checking account records only got back to 1996 from then to now I have never bounced a check. This debt (if even mine) is 10 years old. If I'm not mistaking the sol on this type of debt is 6 years in MA. Should I worry about this check??? They can't put it on my credit report because it is more than 7 years from the date of first delinquency right? I haven't checked my credit report in two months, do I have any recourse if their is an inquiry from the collection agency?

    I did make a mistake and call the collection agency this morning. I told the rep the debt was 10 years old the can't do anything about it now. He started to argue with me and said "We'' see what happens", and hung up on me.

    Any Ideas on what to do now?

    Send a C&D immediately, they can't do anything to you civil or criminal.

    This debt is way past the SOL for either matter. If they persist or damage your credit you could really make some money off them.

    Send out that C&D certified so you have proof if you have to sue them that they really got it.

    You don't need to get into specifics with your C&D, a simple C&D form letter will do.
