Live in Glendale, AZ and was offered a job in Connecticut. Have a 1 year lease with Pillar Communities and gave 30 day notice. Had 5 months left on lease. They charged me 3 months rent for breaking lease agreement. 2 automatically for break and another for the promo of first month free when we moved in. That's $2600 - SUCKS!! I can understand two, for the freebie month and another to ready and find tenant. The idea of paying a third month when someone could be moved in and paying already is absurd. Is that not douible dipping-collecting two rents at same time. Well, I'm told breaking the lease is a separate billing-has nothing to do with rent. Any ideas on AZ renting law? They did offer 24 month payment schedule- much too kind.
I don't know anything about AZ RENTAL LAW...BUT they MUST MITIGATE DAMAGES...they have to try to rent it A.S.A.P. "IF" they rent it out right away...they may not be entitled to any rent from you other than "ACTUAL COSTS" cleaning-painting-advertising-showing-etc
The key will be to find out if someone did, in fact, rent your apartment. They cannot collect double rent.
Aside from a subpoena, anyone familiar with a California law that mandates disclosure of the "rent roll"? In other words, how does a consumer find out if the apartment was rented? Thanks for any input.
