    Is it 30 days form when I send or they receive. Date on my letter was 30 days ago...but don't know if I sent it that day or day after.....green card signed at least a few days after. I go home every day wondering if anything is there waiting for me.

    1*The property management company - a nationwide firm - had her forwarding address but at no time ever mailed any type of document itemizing costs of applicable repairs (as required by Texas State law).
    2*So tell me, given those conditions would you pay the $850?

    Couple of things...which depend on state law.

    First, many state laws require landlords to give itemized list of damages. Usually there is a time limit for them to sumit this to you, and usually it is very short - 30 or 45 days. If your state has this kind of law, it may even say that your landlord cannot even take your deposit if they don't submit this paperwork.

    I knew someone who (with his roommates) left his apartment completely trashed. They had had several dogs. The landlady even brought the significant pile of dog hair culled from the HVAC filter to court. But she had not given them their itemized damage list within 30 days. Landlady lost her case, and my friend and his roommates were awarded their deposit back.

    Got a regular ole' collection letter from the CA on this case. No validation, nothing....just a regular, every day you owe us....pay now....before we report....blahhh blahhhh blahhhh.

    Aren't they not supposed to collect without validating first? Is this another FDCPA violation?

    Do I do anything now or wait until the 30 days are up from the initial validation letter?

    Would this be a good time to let the OC know that they could be in hot water with regards to the actions of the CA?

    From what I've read, the OC is in hot water for breaking the Landlord/Tenant Laws of your state--from the information you gave here.

    Why not start a two-pronged approach?

    1*Wow, it must be a great feeling to encourage people to shirk their responsibilities in life, huh?
    2*The guy signed a contract, and he owes the landlord money because he wasn't able to live up to the terms of the contract.
    3*If he's dishonest, he will try to find a loophole to squirm out of it.
    4*Trying to find loopholes in life to avoid your responsibilities doesn't do you good in the long run.
    5*The irony is that, even if he does avoid paying the bill, he will screw himself for years to come, because he's now on countless databases as a bad tenant..
    6*The longer you wait to settle with the landlord, and the more trouble you cause for the landlord by playing the validation game, the less likely they will be to settle with you.

    3*It's not about loop holes its about doing things by the book.
    4*I haven't seen the proof that he is responsible. I will use every loop hole there is to defeat anyone who is trying to put the screws to me. In fact I might even invent a few loopholes!
    5*So the LL has just set him self up for another lawsuit.
    6*No comment except this one is plain stupid.

    I have my estoppel all ready to go tomorrow. That is 30 days since they received according to the green card.

    So far I have them on:

    1. not listed as disputed with 2 CRA's
    2. pulled 2 inquiries since receiving validation letter
    3. sent collection letter
    4. pissing me off

    Well th estoppel was sent yesterday. So I figure they will get it Tuesday or so and I should have another hard inq. come Thursday!
