Business owner question...

    I own a contracting business. I received bankruptcy papers for a customer I haven't done business with in over 3 years. He lists my business as someone he owes. There is no dollar amount. The problem is, he doesn't owe me anything.

    Should I ignore the court documents? I received it yesterday by mail. It is requesting a motion to modify the automatic stay.....no idea what it means, but he is trying to sell his house. The real estate contract is also enclosed.

    What would you do?

    My main concern is fraud on his part. Why would you list someone you owe, if you don't?

    You might also try posting this question at www.chat-cards.com - it's a board exclusively for BK related issues. It sounds like he is just covering all his bases - when I filed BK I included the bank that had foreclosed on my house just to protect against future action. I would be more concerned about fraud if he were attempting to hide information from the courts, not for revealing too much information. You could always call the trustee and ask if you were listed as a creditor in the case, and if so, for how much.
