I started my credit repair journey in April/2003, before discovering CN, I sent a dispute letter regular mail to CA, when CA rec'd my dispute they pulled a hard inq... Is that legal???

When you mail a validation/dispute letter can a CA pulled a hard inq? CA it's past SOL...

    Please help....

    Thanks!

Technically speaking yes, they can. Try sending the second in the series, (CRRR this time) and be sure to reference the fact that they ignored your first letter of April xx, 2003, in the form of a question.

i.e. "Why did you ignore my first"?.

Maybe you'll get lucky and they'll acknowledge it's receipt.

Not time to talk about the inq. yet though.

    Welcome to the board.

Why isn't that a violation, fave Butch growling dude?

    What's the technicality?

I believe it is a violation.

    Now I'm confuse...

I know for a fact that a CA can do a hard inq once CA inserts the neg TL, but in this case, the neg TL was already inserted on 2001 and after I mailed them a dispute letter on April 2003 they did a hard inq.

    Can someone please explain further...

    Thanks,

    Dusty

Perhaps Butch is saying since it was sent regular mail not CRRR the Court would hold an individual to a higher standard than a CA or Attorney who regularly send regular mail. Since the consumer can't prove when it was sent if the CA acknowledges they received before the hard inq. it would be a provable violation.
