May xx, 2002 Credit Bureau xxxxxxxxxxxxxx xxxxxxxxxxxxxxxxxxx Cert Mail # 7054 7512 3698 5298 (RRR, 2 pages) Regarding erroneous listing on my credit report. Dear Sirs: I understand your desire to have me demonstrate my identity. However I don't believe I am required to provide all that inconsequential information on your questionnaire. This request is properly notarized and a copy of my Social Security card is enclosed. I received a form from the collection agency, (the first time I was made aware of the identity of the alleged original creditor) asking me to sign so they can obtain validation from the original creditor, and also contained an agreement, again requesting my signature, that I am responsible for this erroneous bill, (copy enclosed). This form was sent AFTER they received my dispute with them. Since I made this request last week I've done my homework. This Doctors name is Dr. Alex L. Kushkin, who is alleged to be the provider of service. Incredibly Dr. Kushkin, (if he really is a dr.) is now doing time in a federal penitentiary for making false claims to collect insurance, writing himself prescriptions to feed his drug habit, etc., among other crimes. The indictment, (which I obtained off the net) states: "the defendant Dr. Alex L. Kushkin, filled out documents which indicated that he performed podiatry services,..... when in fact he performed no such services. These documents were used by office staff employed by defendant ... to prepare claim forms which were sent to Medicare." (copy enclosed). It's obvious that Medicare is not the ONLY recipient of these fraudulent documents/claims because I now am being billed for something for which I DO NOT owe. Though I do know my rights pursuant to the FCRA and the FDCPA, (I know you know my rights too) I am unfamiliar with such areas of law as FRAUD, COMPLICITY IN THE CONTINUING OPERATION OF AN ONGOING CRIMINAL ENTERPRISE. RACKETEERING, EXTORTION, RICO. You name it. I am justifiably very upset and by the time I meet with my attorney staff Friday, I will be extremely familiar. May I suggest that you remove this item from my credit report immediately, if not sooner, and thus avoid potential culpability. After all it is perfectly obvious they cannot produce the information which I am entitled, by law, to demand. This letter in no way should be considered a waiver of my right to pursue this further. Thanks for letting me ramble and thanks for your help. Warm Regards, *************** I figured heck, with a case like this I might as well have some fun too. This is all true too, btw. enjoy, Warm Regards,
That is a GREAT letter! Excellent wording and delivery! A winner for sure. Are you just mailing it blindly to the CRA or sending it to one particular person?
Thanx Guy's I don't have an individual to send it to but perhaps that's a good idea to call and get a super's name first. I don't think I'd ad it to my collection though Javan. After all this entire situation has become so weird none of it would ever apply to anything you'd ever encounter. I put that letter on here for a couple reasons. First, its sort of an update to my thread called "astonishing ca stupidity" posted about 2 weeks ago. It's at: http://consumers.creditnet.com/stra...highlight=astonishing+ca+stupidity#post177398 Several emailed me privately wondering how that case was going. Secondly, It's a good idea to severely change the form letters we see in the "letter's library" Ya don't want the CRA's to know how knowledgeable you are. Or that you visit these boards. Ad that personal touch. In this case I think I sound a little crazy. Like, my god, this crazy ba$trd might do anything. lol Thirdly, it was almost 3 am, everyone was asleep and I was bored. All this stuff in the letter is true. It's amazing what you can find out when you dig. This Dr. will have a tuff time validating, don't you think? I'm sure he doesn't have my wife's contract under his pillow in cell block 6.
Change which letter, LOL? My nutcase letter isn't found in the library -- it doesn't belong to Creditnet. Doc
By the way, speaking of digging, About 5 - 7 days ago a guy posted on here with about 8 - 10 links to some web sites. One of those sites was an excellent expose' on CR's from TU. I think the thrust of the conversation was the fact that TU doesn't report disputes as disputed. Someone said "glad you could stop by" so he's not such a regular. DOES ANYONE KNOW WHERE THAT THREAD IS? Please advise,
I did write that letter, LOL, but I never asked Creditnet to put it in the library. On the other hand, I did post it to several discussion boards, including this board, Michael Kielsky's Credit Repair group at Yahoo, the Creditwrench discussion board, and to the Fair Credit Movement board. Obviously, anybody can use it since I released it into the public domain, just like everybody else does when they write a letter and post it publicly. I just wanted the letter to benefit the maximum number of people; if it appeared formally on somebody's website, then that website might lay some claim to it at some point and may not give reprint permissions, etc. Plus, I really get a charge out of taking credit for my work, LOL (some little boys never grow up). For those reasons, I didn't want it to become institutionalized on a site like that. (...Unless I put up a website myself, LOL -- hey, is DOCSTRICKS.COM taken???) Doc
Hey this post reminds me of a new show. Has any one seen the show the mole......... Is thier a foil among us? :0) Oh no!!!!!! Just kidding . Or Am I? ...............
CASE UPDATE!!! Thanx Family, Well ... I finally got around to sending my dispute in on this case and got the CR back today. "Item Removed" I really don't think the CA wanted to deal with me on this one. This debt was placed on Sandy's file and the Dr. was subsequently arrested, de-licensed to practice medicine and imprisoned for filing false medical claims. He filed false claims to acquire free money to feed his drug habit. One of my threats was RICO. The CA was participating in the Drs. ongoing racketeering scam by attempting to collect on one of those false debts. Case beginning; Astonishing CA Stupidity! http://consumers.creditnet.com/stra...ghlight="astonishing+ca+stupidity"#post177398 Special Notice to Newbies; The ONLY reason this worked is because of all the help and advice I've recieved from the folks on this board, AND I studied my ASS off before I took action
