The main premise for this letter is to state, there are legal issues with your right to collect on this debt. It is my understanding that a collection agency does not have to be licensed to conduct business, but they do have to be registered in the state in which you are collecting the debt. According to the FDCPA, a collection agency cannot report to the credit bureaus as a third party. The collection agency must act in their own name. Your company, Gold Key Credit is an affiliate of Marlin Integrated Capital, which, ultimately, is NCO Financial Systems. NCO owns Marlin Integrated. All of your services references to NCO Financial Systems. Therefore, I am addressing this concern to your company because both NCO and Marlin Integrated Capital are reporting on this same account with all three credit bureaus. This is clearly a violation of the FCRA and FDCPA. It is my request that Marlin Integrated no longer report this account (and any negative trade lines) on my credit report.
