C&D for OC???

    I had a really nice phone conversation with my car finance company today. I told the woman that she cannot call me at work because
    1) I can't receive personal phone calls at work
    2) I don't get to work till 9:eek:opm, so there is no way they can reach me here anyway.

    She told me "I will call you wherever I want"

    Here's the deal: I am 22 days late. She called me Tuesday and I told her I would be making the payment next Friday. She said that was fine. Apparently she thought I was saying this Friday because she has been calling me all day Friday and Saturday. When I talked to her she denied saying next Fri was OK and says that I said I would be making the payment yesterday. She screamed at me at the top of her lungs, laughed at whatever I said, refused to let me talk.......

    This company has my cell phone number and my work number. They will not quit calling no matter what I say. I will be making the Dec payment Friday and the Jan payment (due Jan5) the following Friday then I will be caught up. I want to send them a C&D telephone contact letter. Can I cause myself any problems by doing this? After I am caught up I want to put the account on auto-pay so I will not be late any more so they should have no reason to call me anyway.

    Should I modify the C&D listed in the sample letters? because they reference the FDCPA and that does not apply to an OC.

    You will have to check your state's laws to see what they say about OC's.

    i would contact her boss. tell them about her behavior and that if it doesn't stop, the next call will be from your lawyer.

    a lot of people here will tell you to do everything in writing, but for the initial contact i recommend to people to go to that persons supervisor or even the companies human resources department. get them fired.

    they give lenders like me a bad rap.
