I have another question guys, sorry I ask so many questions. I'm just so new at this, but I promise I will get better at it. I have several collection accounts on all three reports. From what I can tell it looks like some of the ca's are reporting two and three times the same account, same balance, dates etc, but just under different names. for example I have one that says $205.00 under the name Medclr, then it shows again under the name nco, then again under Medclr Inovision. To me it sounds like it is the same company but using different names. Is this illegal ? and if so what can I do about it. kathy
kathy, You could dispute the account as "duplicates" with the CRA's. If they're using the same exact account numbers as well as balances and dates, then they should come off with no problem.
Mindcrime, I disputed a paid collection and not only did the disputed one remain (verified) but another showed up for the same debt. This is how its listed: Credit Grantor: ENEMY COLLECTION AGCY Account #: ABC1234* --This item does not belong to me. -- I have never paid this account late. -- This account is closed. -------------------------------------------------------------------------------- Credit Grantor: ENEMY COLLECTION AGCY Account #: DEF1234* -- This item does not belong to me. -- I have never paid this account late. -- This account is closed. What angle should I take to get rid of both of them?
I don't know what you can do about this, but I have a debt from Medclr also. The CRA verifies it everytime I dispute it, gives me an address and phone number as well. But when I called them up, they answer by saying NCO. I hope this is illegal, but my two debts with them are near the SOL, so I am trying the validation efforts with Medclr first.
No it is not. But they do it all the time. They are actually all the same company (different in name only) but it is wrong. It would appear as if you have 3 separate debts that they are collecting on when in fact it is one debt. Send validations to all. Make them provide accurate information including proof that they are legally able to collect on the debt. -Peace, Dave
Love, If this is the same account, i.e. same bal. same OC, etc. you should just be able to dispute it as 'duplicate account'. Of course, this would only remove one. If you're looking to get both removed: Have you sent a validation request for the account? How old is the account? Within SOL? Is it a large debt?
Have you sent a validation request for the account? Yes, and they sent me nothing. How old is the account? The debt was incurred in 2000 Within SOL? Yes? Is it a large debt? No, less than $150. And I already paid it.
I'm difinately going to try and dispute them as duplicates. I'm also going to send validation letter to all of these CA's. I'm wondering if the FTC would be interested in knowing how this CA works, What do you think?? or even the better business beurau. As soon as I get solid proof. Would anyone know how you would go about trying to find out if they are legally right ? FTC?, Antorney General ? etc...? It seems that a few people are having problems with NCO,Invovision and Medclr.
Oh, the notorius NCO. They buy debts from the OC and most likely won't be able to validate. They are all one in the same. They don't respond to validations and will deny even receiving a request, when you have your green card in hand. I would start building your paper trail. Send validation letters to all. Wait 30 days, send another. wait the last 30 days send estoppel and intent to sue and give them 15 days to respond. When they don't respond. Dispute with the CRA's when/if it comes back verified, bammm you got them. Then, go to court with all the violations you got them on and sue the snot out of them. ; ) I just had mine deleted, so at the moment I don't have the pleasure of seeing them in court!
Love, If you've send the validation request and the CA has not responded, and it has been over 30 days, send out the estoppel. Include with the estoppel copies of the previous letter you sent, as well as a copy of the green card (signed of course), along with a copy of the FTC opinion letter LeFerve CASS. I forgot to ask last time, is this on your report and if so, after they signed for the validation letter, did they place the account in dispute on your report(s)? If not, be sure and point that out to them as well. I suggest adding in the pertinant FDCPA and FCRA sections that they have already violated. Also, filing a complaint with the BBB, FTC, and their state Dept. of Commerce and AG's office might light a fire under them and make them "see" that you mean business (coupled with your estoppel ltr) and that they should simply do the right thing.
