I have had the pleasure of having *2* arsebites from Williams and Fudge in NC call me today of a debt that was written off in October, 1997 re: a ""debt"" from 1989. I have had it up to here with them, and would like to know if anyone has a suggestion as to what I should do now. Can I still write them a validation letter, or am I too late? (This had been going on for several months, now.) And what kind of letter? The 'hey, I don't know what I'm doing, but can you tell me just what this is' letter, or do I hit 'em with the legalese-one? I lived in KY when this debt supposedly occured, and I now live in IN. Also, would it be wise to "opt-out", delete my old addresses, and then write the letter? Any advice is appreciated, as I am currently out of a job (as of 5/7/04), and this is only adding to my stress level. Thanks! Maddie
Sounds like this debt is "probably" past the SOL for a lawsuit. Check your state's laws first. If so, send them a letter Dear W & F Go pound sand - do not contact me. Have a nice day!
If they've confirmed the date that it went bad, and that date is outside of the SOL, I would jump right to a C&D. I typically like to cat & mouse them a bit first, and request validation for *PROOF* that it is beyond the SOL, then slap them sillier with the C&D, after they went through the work to prove that it was outside the SOL. (Is that too evil? ) You could send a validation, and add that all future communications must be in writing, and that would end the calls. Of course, they more than likely can't report anything (without reaging), the only thing they can do is pull your credit file, hard. WhyChat has a time-barred C&D letter on their web site, you should be able to find it by looking for any of their posts. Its a fairly simple fill in the blank, the only thing you need to look up is the SOL code for your state, and plop it into the letter. If you search for "Statutes of Limitations" +(spell out your name), you should be come accross a few articles which include a listing of the state SOL code references for all the states.
About the ending Go to a search engine like google. And search for "Statutes of Limitations" +(spell out your full state name) And you should come up with a few artlicles like I mentioned, too quick on the typing, and the connection was slow enough that I couldn't edit it...
I knew there would be an easy way to find WC's letter... I just sent out one copy of WC's letter heavily customized to 2 CA's and the OC for 1 account. EX said I had to notify the OC that the account was fraudulent, they didn't say HOW I had to notify them.
