Quick background. Working with a debt reduction sompany. Haven't made any pmts on some cards in a year and a half. But, now I'm trying to make everything right. OK, so I've come to find out that there is a guy Dan, (from a CA), callling my family members, and telling them I need to call him. My 89 year old grandfather, for example, has received 2 phone calls in the last 2 weeks from this guy. He's telling my grandfather that "there has been some big charges on your grandsons credit card, and that I need your grandson to call me ASAP". WTF. My grandfather calls me all flustered, and tells me to call him. Then get this. This Dan guy left the same message for me, on my Brother-inlaws, brothers, answering machine. I mean, what the hell. How does this guy even make the relation? I've meet my brother-inlaws brother like 5 time total in my life. Is this CA breaking any type of rules/laws? It pisses me off that he's calling my 89 year old grandparents. He's calls them at least once a week.
FDCPA violation, and possibly also under your state's consumer laws. See 15 USC 1692b: http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm#804 "�§ 804. Acquisition of location information [15 USC 1692b] Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall -- (1) identify himself, state that he is confirming or correcting location information concerning the consumer, and, only if expressly requested, identify his employer; (2) not state that such consumer owes any debt; ..."
Have they already been able to contact you, either by phone or letter, or have you disputed in writing, so they know what address to reach you at? If so, they have no reason to be contacting family members at all, and they are doing it purely to embarass you into paying.
In some states, this may also be considered harrassment, which may be a criminal offense. You may want to call the local DA's office.
