My boyfriend and I have 3 children, ages 9, 7, and 4. When I was pregnant with my 7 year old, I filed for AFDC, and was required to file for child support (we split up briefly during the pregnancy). I collected AFDC for about 7 months, and began working full time when my daughter was about 3 months old. By that time my boyfriend and I were back together. We have lived together ever since, and have had another child since then. My boyfriend now owes thousands of dollars of back child support, although he has actually been living with the children and caring for them (I work full time and he stays home with the kids). Is it possible to have the original child support order completely reversed? He would like to get his drivers license back and plans to begin working at least part time now that our youngest child will be in school, without having child support withheld from his wages. (Also, I have since repaid the county for the aid I received).
i would talk with a lawyer. technically when he moved back in you should have notified the county. even though he moved in he still should have paid the support because it would be just going back into the household. i don't know if they will cancel the arrears even though he was living there.
I don't know about what state you live in, but I have personally dealt with Kansas, Missouri and California. We had a similar situation. The child support was owed to me. I had to write out a letter stating that I was waiving all back support considering it paid in full and closing the case. I had the letter notarized, sent it CRRR. It took about 6 weeks, but the child support was eventually stopped and all back support considered paid. The trick is to get a contact name that is dealing with your case. Hope this helps.
in my experience if the county is paid back its AFDC arrears the case can be closed and any cs arreas cancelled if you request in writing explaining your situation. you will most likely need assistance from an attorney to get his DL back. make sure the court order gets dismissed as well.
Same with me. Im in NY and I and the father had to write a letter to the AFDC child support enforcement office telling them I (we) no longer needed their services to collect etc. No longer on AFDC, and any back arrears was deleted when they found out we were together the whole time
