I wrote two checks that were returned for insufficient funds (I know, I suck!). A CA starting sending me notices for the checks, then I notice when I check my checking account that the store in question redeposited both of them and they cleared. The CA is still sending me notices to pay, though, and they want the amount of the checks plus some other fees. What should I do, send them a letter? Since the store redeposited both of the checks and they cleared, if I have to pay the store a charge for the returned checks I guess I have to but I don't want to pay Telecheck anything.
You probably have to pay the store a fee...I DOUBT THEY WILL WAIVE IT... As far as TELECHECK you don't necessarily have to pay them...BUT they also DON'T have to "CLEAR" you either... You will be DENIED at every business that use them!!! I'M SURE GLAD I USE CREDIT CARDS FOR 100% OF MY PURCHASES!!!
I was thinking of sending them a letter showing that the store redeposited the checks. I'm assuming they will take those amounts off the total then. If they send me new statements and I completely pay off the charges, do they usually take you off the blacklist then?
Or should I send them a validation letter? They can't validate it if the checks were redeposited and cleared, at least not the original amount of the checks. Or ... cease and desist and tell them to bugger off? I guess I'd rather just work with the store and maybe they could get it back from Telecheck if I pay them the bank charges. Would that mean that it wouldn't be on record anymore, if they take it back from Telecheck? Sorry for all the questions, but I'm so afraid of doing the wrong thing.
Just a thought. Are you sure that the original company cashed the checks? Have you received the cancelled checks back? Telecheck works a couple of ways. One is purely a check to see if they have anything bad on you in the system. It Telecheck clears it and it bounces, I'm not sure what happens. But Telecheck also has a 'guarantee' service where if they pass the check but it bounces, the merchant gets to keep the money and it's Telecheck's problem to come after you. Any chance that Telecheck really cashed the check and their letters are hosed?
You are right! I found out that it was Telecheck who redeposited the checks, not the OC. Of course, now Telecheck wants their $25 fee for each check that bounced first time around. I don't really care about not being able to cash checks at stores anymore, I actually weaned myself from that almost completely already. I hate that it's going to haunt me now though ... live and learn I guess.
