I have a medical acct that I owe. The CA collecting on it has numerous collection infractions and I have filed suit in small claims. I was intending on paying it (they have never properly verified) with the statutory award I win in court, however I've recently come into funds to pay it now. I want to pay the OC, then dispute with the CRA BUT will this affect my case in any way? My only thought is that I'm arguing that they continued collection without validation - would it look bad if I pay it?
It shouldn't look bad.... you are suing them for a specific violation of the law that you can prove, that really has no bearing on whether you pay a debt or not
PD - I guess my concern is that they'll wonder why I paid it when I'm complaining that they continued to collect on an unvalidated debt. The other alternative I thought about was to hold onto the money and pay it as "I'm not admitting to this debt but want to settle it...." I just don't want to screw this up, they are into me for 4K in violations.
I know what you are saying and what your concern is, but there are really 2 distinct events here: 1- the fact of the matter is that whether or not you pay them, they still violated the law by continuing to collect on an unverified debt for which they can be held responsible 2- You wish to settle this matter by paying it without admitting liability In the eyes of the law one event has nothing to do with the other
