I posted my problems with this CA yesterday. They have not replied to my validation requests, and I called the hospital to find I do not owe anything on any of the 8 accounts they have reported. This morning I called the Hospital to ask for a printout showing I do not owe anything, they said what happened was the CA did not collect, so an Attorney received the accounts, that is who I paid. I did pay these accounts through an attorney's office. So I phoned the attorney's secretary and explained I needed them to call the CA and have them remove the accounts from my report as I had paid them. She said to give her some time to research the accounts, then she would call the CA, and phone me back as well. I pray I didn't mess this up! I told her since the CA had been reporting erroneously and incorrectly they had to delete. Tell me I haven't messed up here. According to the CA, in their letter to the BBB, they verified the all but 2 of the accounts with the CRA. So, they have violated the FCRA. If they list the accounts as paid collection I think I have a case here.
Stop praying, you did EXACTLY the right thing The CA can NOT validate ... so they LIED (wow a CA lying go figure). Validation entails the CA contacting the OC and having them send proof...a thing you have already verified can NOT happen. So they have violated the FDCPA and the FCRA at that point (8 times hehehehe already capped small claims court maximum . The continued collections, another violation (times 8). The letter to the BBB, and the hospitals statement, is ALL the proof you need that the CA states they verified an UNVERIFIABLE listing. (quite a tough thing to do even for an UberCA). I would accept NOTHING less than the CA COMPLETELY removing the erroneous listing, or I would sue them for the maximum small claims court allows. Simple answer, "yes, you have a case" if they refuse to delete. -Peace, Dave
Well the hospital put me in touch with the legal department, who then phoned the CA and told them they had to remove the accounts from my report because I had paid them in full. The CA asked them to tell me it would take between 48 and 72 hours to remove the accounts, so I decided to write a letter asking the CA to send me a letter stating they had removed the accounts no more than 5 business days from now. I was generous. I then said if they did not remove the listings, or reported them as paid collections with their office, I would not hesitate to file suit, and claim damages of $1000 for each account. That should cover my bases.
