Re: Re: CA Ignored My Validation Letter Can you prove you don't owe it? Yes? Send cease & desist letter. No? Ask Butch or Sassyinaz what to do. Might be. Getting sued for a debt you don't owe would be worth more. lots more.
Re: Re: CA Ignored My Validation Letter Buck: I have done two things when I've been contacted after the validation request, with another request. #1) Just send a copy of the original validation letter that they received, with a "On xx/xx/xxxx, received by your offices on xx/xx/xxxx at xx:xx AM by ______, I requested the validation of the alleged debt, from your offices, and as of yet, I have not received said validation. Please advise on the status of this validation request, at the earliest possible conveinience." #2) Send a more agressive validation letter, with a copy of the original validation letter included. This would be the one where you would detail their violations. Remember, that having an attorney contact you, is an indirect threat of a law suit, because to the average consumer, LAWYERS SUE! Was your letter from the lawyer personally signed, facsimile signed, or not signed at all? If it is signed with anything less than the personal signature of the attorney, then the attorney has not personally reviewed the case to ensure that the case is actionable by his client, and the threat of legal action is false and misleading. There are a number of rulings on this issue, and I still can't believe that there are a number of 'lawyers' who still facsimile sign their automated communications, or worse yet send them unsigned.
Re: Re: CA Ignored My Validation Letter I can't proved I don't owe this debt, because the bill is for a service I have never used, from a business I have never frequented (I don't want to get too specific). I think THEY should prove I owe this debt. Isn't that the purpose of validation? The letter from the attorney is not signed, it just has the typewritten name of the attorney. It is an exact copy of the first collection letter I received (complete with a sarcastic line saying they can't believe I haven't taken care of this already). There is not way it got crossed in the mail with my validation letter, because I received their second letter more than a month after I got the green card back. Has anyone here ever gotten nasty with a collection attorney or CA that ignores validation letters and continues to try to collect? What did you do?
Re: Re: Re: CA Ignored My Validation Letter The way you get nasty as you call it is to send the CA an ITS letter & if they don't come around file suit for the violations.
Re: Re: Re: CA Ignored My Validation Letter What record does this type of transaction typically create that is tied to the ordering party? Is the business or service of the sort that has a high level of fraudulent accounts?
Re: Re: Re: CA Ignored My Validation Letter No validation. I know there is a violation here. A collection attorney should know better. Buck =================== They don't because it don't make any difference who they work for. ****************************************************** NEW MEMBERS READ THIS. http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&postid=410243#post410243 ******************************************************* >
