When I dispute an item placed on my report by a CA by means of disputing as "not mine" with the CRA, should it show up as "in dispute" until the CRA decides whether to delete or not?
Tom, Yes, the CRA is required under the FCRA to list the account as "in dipsute" but rarely ever do, except for Equifax which I've seen done this a few times on mine. In essence you could sue the CRA for failure to comply with the FCRA but unless you have more to work on you may not get far. If I were to ever sue a CRA it would be for a boatload of documented FCRA violations and then I'd hit them all at once with everyone. The CA or OC when notified by you that you dispute the item is always required under the FCRA or FDCPA or both to communicate to the CRA that you are in full dispute. I have only seen this done by one OC and it stated "Consumer Disputes Account, complies with FCRA requirements" But to answer your question again, Yes the CRA, OC or CA must list the account as in dipsute if you notify them of such.
