Does anyone know what it means if the state comptroller has a CA listed as "not in good standing"?. I imagine this means the CA has not satisfied all state tax requirements. Therefore I'm wondering if the CA should be collecting debts.
Ya not gonna believe this! A CA on my report is not in good standing w/comptroller. I just called comptroller and asked what does this mean. She pulled the CA up and told me their license has been revoked! They didn't file taxes! She said they are operating illegelly in the state! Ok I checked and their bond is still good but they have no license. I asked how much money they owe. She didn't know because they didn't file. Their taxes would be based on the amount of money they collected within the state. Darn I wished they they were not bonded also! You think I can get them to delete based on this info?
Ok I wrote that wrong. She said their CHARTER has been revoked. Do I have something here? She said they must have a charter to operate in the state.
Re: CA not in good standing w/compt matt, I don't want to reveal the name of the CA right now. I will as soon as I get everything together. I think everyone needs to read their state laws very carefully. I discovered all this while looking at state comptroller's site. I am now going to research the state where the CA is located and see if CA is in compliance. The more ammo I have the better.
Re: CA not in good standing w/compt Lizard, Do you think I ought to send a full validation letter and include the info I just became aware of? I think I need to know if they purchased the debt from the original creditor. This could be helpful in the future should they pass the debt to someone else. Also, this account is still within SOL so I need to know if they have an original contract. What do you think?
Re: CA not in good standing w/compt I had a similar situation and validated. They sent a letter saying the account would be taken off, closed with them and returned to the orignal creditor. It never was, I disputed with CRA and it was gone in 2 days. I still want to send them letter asking for damages and delietions. Is this smart?
Re: CA not in good standing w/compt If the debt was returned to the original creditor, sounds like the CA didn't purchase the debt. In my case I'm hoping the CA purchased the debt. If they did, then the original creditor can't collect. Since the CA in my case is operating illegally, they could sell the debt to another CA. However, if there is no original contract w/my signature, as soon as any CA attempts to collect I will validate immediately. Am I making sense?
Re: CA not in good standing w/compt 1* YES 2*If they keep doing this and keep screwing up you could collect a lot of money for violations. If you work it right you could be better off having a bad Cr. Report than a good one.
