Happy Friday All! FIRST QUESTION I have sent 2 validation letters to 2 CA's, already received the green card waiting for the 30 days to be up for CA's. The CA's have not put "Disputed" on any of the three reports confirmed today! By the way is it a violation for each CRA report not showing disputed? 3 violations? If I don't get any responses than I will be preparing my next letter and I have already Disputed this over 3 times with each of the 3 CRA's report always coming back "verified". Please advise if possible. SECOND QUESTION (CRA Legal Proscribed Procedure to Investigate) Can anyone advise of the scope of investigative procedures the CRA's have at their disposal to investigate a dispute? My experience, I am told by the CRA's that all they can do is call and ask if the account is valid and do not have the legal right to get any further information. IS THIS TRUE???? What if the CA's are not giving the proper information? I have already disputed over 3 times for one account with the CRA's and sent a certified letter to validate with the CA. Yes, The CA is breaking numerous laws, not just the FDCPA but FCRA as well. Maybe even your state's laws. The CA is also continuing collection activity by not validating this debt with you and instead constantly verifying this with the CRA's. Send out your letter demanding deletion and your intention to file suit if they do not comply or respond. They at this point will do what they have been doing to you since you started....Ignore you! Good, you want this for court and your lawsuit! I hate to tell you what to do but at this point your only legal alternative is to sue them. You can bet they'll respond then!! As far as the CRAs and their procedures for investigating.....I don't take much merit nor do I think they even do a good job at trying to make sure the procedures they employ are correct. I mean I have in my hand 2 letters from OC's stating they will delete and I give this letter to the CRAs only to have it come back verified. The OC states they were never contacted??? Hmmm...Who lying?? I then ask for procedures and they send me their standard form and generic procedures letter. TransUnion doesn't call it a procedure letter but rather what their general policy is. I don't care what their policy is, I don't work for them! I only care if they are following what the FCRA says and quite frankly they are not. I re-send more letters only to get even stupider letters back. I have had enough and I am preparing lawsuits for a 3 CRAs for months end, for reasons stated above as well as their noncompliance for disputes and not investigating inquiries, as they state it is actual record!!
