CA not validating NOT on report

    I am not quite sure what to do here. I have a darn charge-off that I would really like to go away..lol. The thing is the collection agency that now has the debt will NOT respond to my validation requests. I have sent 4 letters so far. They do not call or write anymore. I want to dispute the debt directly with the credit card company BUT I do not want them to sue for it.

    After sending the letters to the collection company the charge off amount soared and was reported in 11/01. Here is a copy of the listing of one of my accounts. I changed a month here and there to protect me (the Internet has eyes) What would you suggest I do? I see that there are some NA's. Would that be the way to go? Dispute those?

    Sue the collection agency. You have the proof that they can't prove you owe the debt. Plain and simple.

    Erica,

    What would I sue them for? They have not taken any action. They have not called or written since my dispute and have not listed it on my report. The only one still listing it is the credit card company, that is what I want off.

    if you have indeed sent them three letters and they have not responded, then you need to send a copy of the letters with copies of the green cards to the cra with a letter that says the ca was unable to validate this debt, please remove it from my cr per fcra.

    did you send the estoppel and has it been thirty days plus five (for mail).

    Again, this is NOT on my report with the credit bureau. It is only listed with original creditor.

    I am curious as well. I fired off my validation and estoppel letters within the "30 days" and they haven't reported YET (the original doctor isn't reporting either). If they report it's a slam dunk FDCPA violation right?
