Can a collection agency pull a hard inquiry with CRA?? A hospital bill that has been paid by my insurance company from an auto accident sent this to a collection agency. now i have a hard inquiry besides the collection. What can I do???? They call all the time and leave messages......

Yep. As long as they have an account with you.

In fact, some CAs pull your report repeatedly in an effort to diminish your credit scores -- if they think you care about your rating. They even have a name for the activity: They call it "poisoning the file." :(

    LG-
was the hospital bill PIF or do you owe a copay? If it's PIF and the CA pulled your report AFTER it was paid then they can NOT pull your report. They can only pull it if you owe money.

I called my auto inusrance on the claim and was told the date it was paid and how much was paid, I also recieved a letter from insurance that i took to the hospital to let them know it has been paid which they agree it to be paid. The CA is double dipping and trying to collect again now.

Would that be Medclr aka NCO by any chance? If so do a web search on then and you will find they paid a big FTC fine for doing almost that same thing.

a phone representative at the FTC suggested to me that a case could be made for attempting to harrass and opress by "poisining" and that although many CAs do pull a CR they do not have apremisible purpose for a hard inquiry

and that this could be considerserd contacting a third party to get info other than address, phone, employment?

he also said it could be considerd providing false or misleading statements to a CRA because it appears you are applying for credit

EQ told me they are suppopsed to use a method called D-TEC.

i am not preaching this as gospel just sharing what i have been told
