CA Re-Age? Illegal?

    I've been studying my EX report (waiting for others to arrive) and it seems that a CA is not 'playing nice'

    Status: Collection Account $4,xxx past due as of 2-2004

    Date Opened- 9/2000
    Reported since- 12/2003
    Terms- 1 MONTHS
    Date of status- 12/2003
    Last Reported- 2/2004
    Accout History: Collection as of 2/2004, 12/2003

    Terms of 1 Month & still reporting as collection???
    I am a Newbie, but it doesn't add up....

    What should I do/ Info that I need?

    DOLA?

    none- was never in contact with them- Didn't know about it till viewing my report - so..never made payment

    As per report-

    Mothly Payment: $0
    Recent Payment: $0

    I think these guys were the ones that called one of my friends claiming to be a Private investigator...

    What Butch means, is when was the account chargedoff by the orginal creditor? When did you first default?

    On the one thing, an account is in collections indefinately; at least indefinately until it is paid, then its paid collections, unless you get them to agree to a Deletion on Pay.

    Does the trade line say who the alleged OC was, and is there a complimentary trade line belonging to that OC which would list the true DOLA for the alleged account.

    If you are certain that the account is outside of SOL, you could send a validation notice to them at the address provided by the CRA.

    You want to emphasize that you have NEVER heard of them, and that they have NEVER provided you with a notice of your rights under federal law, and you are fully exercising all of your rights under federal law.

    More than likely the 2003 address is the address that they obtained the account, but you need to have the validation to prove that. Yes, you are asking them to provide you with the noose that will hang themselves. :) If they provide it, then you have an "UNRELIABLE" DF case to make to the CRA.

    Sorry that I don't have my CR in front of me- At work ...becoming a creditnet junkie :)

    There is a matching entry/ amount/ from the OC
    The Last activity date as reported by the OC is 2/1998

    180 days at 12/1998

    I'll check tonight and re-post if I was wrong..


    BTW- Most of the personal info on My report is Outdated- 'Current Employer' is a company that I Quit in June 1997 & A driver's Lic # from 10 yrs ago

    Then the sol most likely started sometime within 2/98(or 3/98); depending on your state the account may be outside of the sol. (5 years passed already - 6 years will pass officially as of next month.)

    Depending on the OC, it may be impossible for the CA to validate if the OC destroyed documentation at the 5 year mark. Which could allow you to contest both the OC & CA trade lines since thanks to Johnson v. MBNA, the consumer now has the right to demand that a DF provide a CONCLUSIVE VERIFICATION from the ORIGINAL DOCUMENTATION. :)

    now that I have the CR in front of me-

    OC: Amer. Gen. Finance
    Charge Off: 1/1999
    Last Reported: 10/2000
    180 days as of 8/1998 to 12/1998, 8/1998, 2/1998

    Why are there so many dates for the 180 days?
    This is due to fall off in about a year, right?

    Apologies if these questions seem silly, but still trying to learn & would rather not make mistakes

    Yes, it will fall off seven years after the first delinquency on the original account. In your case, about February of 2005.

    Also, any subsequent collection account that is a result of the chargeoff in 2/98 must also fall off.

    Just got EQ report today

    CA reports
    Date Opened: blank/nada/ nothing
    DOLA: 08/1998
    Current Status: over 120.. (5)
    Type of Acct: OPEN
    Type of loan: Factoring Compant Acct.


    OC reports
    DOLA: 06/98- (EX was 02/1998)
    Charge Off- Transfered or sold...

    Hopefully I won't have too much trouble getting these removed since they report different info to the CRAs

    What is a 'Factoring Compant Account'?

    I think that might be a typo on the report

    Maybe: Factoring Company...?
