CA reporting debt paid to creditor

    Howdy All. I'm new to the board and am picking up a lot of valuable tips. Thanks.

    Question: I owed Lillian Vernon $53 last year and paid them off late. They referred the account to the I C System (a CA). I sent the check to Lillian Vernon (NOT I C System) and now it's showing up on my TU report as a paid collection reported by I C System with a sidebar note that says: Lillian Vernon Corporation.

    How do I get rid of this?

    Any thoughts gratefully appreciated?

    Carefully look at all the information. If any of it is incorrect, dispute with the CA. Don't tell them what is wrong, just write them a letter stating that they are incorrectly reporting your account, that if they can't do it right, to delete it so you don't have to deal with it or you will be hounding them every month to correct it. Send it CRRR to their compliance department. If they try to pull a hard inquiry to find out which CRA is reporting it, hit them for 1,000.00 penalty. i.e. www.bayhouse.com

    You could try the nutcase letter. I haven't used it yet, but seriously considering.

    I am also new, but trying to learn quickly. I am not clear what you mean by sending it to the compliance department. Are CA's required to have a compliance department of sorts? I am not clear on how/why you could hit them for 1000.00 penalty but sounds great..... what else do they do that we can hit them for the penalty????

    OK, I found the check and although it was made out to Lillian Vernon, IC Systems out of MN cashed the check. Is this legit?

    I tried an online dispute with experian and it came back verified.

    What now?

    According to the agency that tracks posted bonds in Texas, the collection agency is actually called â??DATAMAXâ? dba â??Interstate Credit Bureau Collectionsâ?

    By doing business as Interstate Credit BUREAU Collections aren't they violating the FDCPA provisions that prohibit a CA from imitating a CRA?

    Sounds like a big-time violation to me, Am I wrong?

    Very similar to my problem. I also dealt with IC systems in MN on a very small collection account. In my case, I did not owe the money (they mixed me up with someone else).

    Here is the solution I used. The debt is now paid. They cannot make any more money off you so they do not want to waste time on you. They would rather spend their time collecting from someone else so they can make money.

    Send them a detailed validation letter. They know that if they answer it, it woill be unproductive time with no chance of making any money. So, the easier alternative is to delete. That's what they did with me.

    Now the problems. They use a different address for validations than they do for payments. They never picked up my validation letter from the post office and it was sent back after 30 days undelivered. I had to start over. The second time I called and got the address for payments and sent the validation letter there. Put on the envelope "attention accounts receivable" or "payments department" so they will sign for it. (You are not lying when you do this).

    Also, they may just ignore it so you will have to follow up.

    The post office supervisor told me that IC gets as many as 100 letters a day to the validation box, and they are all sent back as unclaimed.

    They are dificult to deal with and you have to be aggressive.

    I don't know the phone number of the PO. I went to the USPS web site and got a number . The number they gave me is not the right one, but if you call it, they can give you the right number. I just remember it took about 10 calls to get the right number. The web site is wrong. Just keep trying.

    And they also gave me the address where IC will pick up their mail. I stored everything away so do not have it available.

    Sounds like willful non-compliance to me. Think we can get a statement from the post office that supports this?

    Ok, I've got my wires crossed.

    This company is Interstate Collecions out of NC. I've got another beef with them (medical collection-Remember, I'm in the military. Uncle Sam's supposed to take care of that one)

    IC System out of MN is the one involved in the Lillian Vernon case.

    Like I asked earlier. If I made the check out to Lillian Vernon, can they just pass it over to IC System and thus allow IC System to report it as a paid collection?

    I'm about to send a CRRR to the address that they will not pick up from. That'll start the basis of my suit.

    If you give some one a check and it can be cashed by just anyone what is the purpose for an endorsement on the back of the check?

    As long as you can prove you mailed it that should be good enough.
