CA reports twice!

    Im currently going thru validation with a CA. I checked my report today and they have added the same "debt" to my report with a different acct number.

    After they received my first letter they indicated that they would mark the "debt" in dispute which they never did.

    Now they have updated my reports with the same "debt" however, this new one is marked as disputed.

    Is it a violation to double report? How about not marking the original "debt" as in dispute? What should I do next?

    dispute the one with the incorrect account number as "not mine" because it really is not yours.You do not have an account with that number so your telling the trueth...:)

    Easy enough, but it still leaves me with a collection. Im trying to make it disappear altogether. Be nice if I had some violations to use as a negotiating tool.

    I would think that doubling posting on your report would be a violation if you dispute the one with the wrong account number and the CRA verifies it.
    but that would be a violation on the CRA, not the CA.

    I sort of have the same problem. I am disputing two accounts from a collection agency one of which I am almost positive is not mine(husbands actually). All the information is the same excepta slightly different account number and an amount that differs by five dollars. I know something cannot be right. To top it off the one account says one dollar past due as of 1/2001.

    I also heard that CA's can not report to CRA's only the original creditor. Anybody hear that? That may be your violation!!. Diane

    If the CA hasn't validated you have them already on fdcpa violations: continued collection activity.. continued reporting (and now a new reporting of a new debt but the same debt) is a violation of not only the fdcpa and the fcra...

    are you in the sol? if so, how much is the account for?

    You can easily sue them for this... but be aware they'll likely counter sue you for the account... assuming they can come up with any proof of the debt...

    you can put the new item in dispute with the cra if you want to with a note that states it's a duplicate of a debt that the ca can't and hasn't validated (include the first validation letter to the ca in the letter to the cras) and send another letter certified rr to the ca that they've now violated the fdcpa and fcra and you want 1k per each violation for 2k total each trade line (4k lawsuit) plus misc expenses atty fees etc...

    add in you want all inquiries off too...

    wait 15 to 30 days and in that interim apply locally for credit and get denied (go to a strict prime bank) and that's your actual damages... and then decide if you want to push it for money and removal or just removal.

    you may also want to send the oc a letter of the violations and tell them you'll hold them liable for the actions of their collection agency...

    always certified rr of course...
