CA Responds....

    I sent a letter of validation to a CA.

    They responded with a letter:

    Dear Ms. Jones,

    In reference to your letter dated 04/15/04 we have enclosed the following payment history printout from our client regarding your account # XXXX.

    Please remit a check for the balance owed of $xxx.xx and make paybe to Tri Area Collection Co.

    Thank You,

    Ima LousyCollector

    ________________________________________________

    The did not return the disclosure form, nor have they reported the account as disputed. I guess they are assuming that I would be "satisfied" with the printout?

    Do I call and attempt payment for deletion? Any pointers?

    -Disclosure form?

    "nor have they reported the account as disputed"

    -They are not required to report the debt as disputed if they sent you verification.

    "I guess they are assuming that I would be "satisfied" with the printout?"

    -Well, unfortunately so is at least one court. The standard is if the statements:

    1- Identify the consumer, and

    2- Identify the amount of the debt, including an accounting.


    "Do I call and attempt payment for deletion? Any pointers?"

    -Is there anything "wrong" with the listing itself. Other than being a collection account of course?

    -Try to think outside of validation/verification :)

    Hi.. I am new to this myself, but have really been reading and studying up.

    It is my understanding that the CA should report that you dispute the Trade Line. I had a similar situation where I only received a partial print out... the print out did not have any details of my original contract, amount owed, break down of how this CA arrive at the amount I owed, nor did they show anything that represented they were an actual collector for a comapnythat I had wronged.

    I went online to Exp & TU and disputed this account as NOT MINE. Removed from TU, still pending on Experian.. I will keep you posted.

    My next step after reading through several of these posts would be to send a second dispute letter with clear cut request for infomration, reminding them of your rights under 623b

    Here you go with your "think outside of the box" techniques............JUST SAY IT ALREADY!! LOL

    I don't see anything "wrong" with it...It's a collection account I want it off my report and that's that.

    I don't have that insurance anymore and have no way to contact them, in fact I think they went O.O.B.

    I just reviewed the "statement of the account" from the OC, that the OC faxed to the CA......

    It shows charges, some "credit" from 'patient payment', and than it shows other credits but it doesn't say if it was an insurance credit, or not.

    Oh and ??.....from what I've seen SOL for MI is 6 years, some of these visits were from before I was 18, other visits were EXACTLY 6 years and a few weeks ago, does this make me exempt?

    Out of business, or purchased or merged with another company? Perhaps contact your state insurance commissioner.

    if i understand you correctly, you are stating that the insurance co is oob ?

    do you have any documentation as to your old acct # or coverage that you can obtain.

    was this insurance through an employer or was it state medical or medicaid i think its called in MI ?

    if if the state, I have great news for you if its through an old employer, they may have records possibly.

    I know in Ca that the new hippa laws have enabled these insurance co/ doctors to destroy records after 3 yrs.

    a computer printout from the Ca may violate a state law as it may give oout info relating to charges for certain services that were rendered.

    let me know the answers to the above questions and ill post more.

    It's was through my dad's employers insurance. I think I found an old statement from the Insurance Co. from something else, so I may have the policy number. etc. I LITERALLY just found it while waiting for Ol' Dial Up to connect, so I haven't called yet. But I doubt they would even be open, IF they are still around. I inquired about the HIPPA and butch said it wouldn't apply. But here's a question because I was reading a lil' about HIPPA today. The statement that came to me from the CA, which the CA had the OC/Doctor's office FAX to them, states:

    Dates of visits, and a "general" briefing of what the visit was for. I.E. "Psychotherapy Intake"..."Individual Counseling Assesment" etc. etc. To me that was telling everyone in the CA my personal "mental" medical health, that I've been to a "pshycologist". It was "family" counseling, but still who is to say that Joe Blow from Tri Area Collection Co. doesn't think I'm a nut with some weird mental problems? (hmmmm maybe it wouldn't be a bad thing if he did hhahahahaha)

    I don't know the laws in your state, but in mine <18 is not legally bound to a contract.

    Can you work THAT angle?

    My belief on the SOL is that it calculates like this.

    Date of visit to the doctor is the date the written contract was signed, which is the date that starts the SOL clock. In your state 6 years.

    This is how you decide your defense in court if they sue you, as it's SOL.

    Next, we have the date calculation for CRA. That's the original date of Dr. visit. Plus ~6 months for the charge-off to hit his books. Plus 7 years from that date for the CRA to report the negative TL.

    Everyone, is this right?

    nutcase lol I think it may be safe to say that some or most of us on this CN are becoming that way lurking about plotting to catch the Creditors or Ca in a trap so we can sue and have perfect credit again
    wouldnt that be nice fix your credit yourself and collect $. hey theres my new full time job lol I wish.

    anyhow about the acct were you under 18 at the time? if so goldhummin has a point I dont think that they can legally come after you for that and put it on your credit. if so go for deletion.

    if not plan b pursue the other options we talked about earlier.

    Yes, I was under 18 by about two weeks when I initiated my visits to their office, and I did indeed sign the paperwork myself. I thought it seemed funny that there would be a bill to me and not my dad. Which they can't bill my dad anyway as it's past SOL. So, do I call the Dr. and explain this to them or do I call the CA and explain to them? Or do I write a CMRRR letter to either or both.

    How about i Just call em' both up and say "I'm craaaaaaaaaazzzzzzzzzzzzyyyyyyyy.....delete it or else?!" LOL
