Re: Re: Re: Re: Re: Re: CA Responds.... You might want to check your states Age of Consent laws before you do anything else. People under the age of 18 CAN consent for medical services in certain situations. For example, in most states ANYONE can present to the health department or hospital (ER) requesting treatment for a sexually transmitted disease and consent to said treatments. The hospital or health department IS NOT obligated, and is prohibited from calling the child's parents with out the child's permission per HIPPA and the other existing standards of privacy. I know this to be a fact...i'm a nurse So, if your situation is one where you could consent for services...why would you not be responsible for the bill...afterall, you were only 14 days away from being legally grown...
Re: Re: Re: Re: Re: Re: Re: CA Responds.... !4 days or 14 years away it wouldn't matter in a court of law. What about an underage girl who engages in sex with an adult? Would the adult not be charged with statutory rape since she was ONLY 14 days away from legal age?
Re: Re: Re: Re: Re: Re: Re: CA Responds.... The hospital or Dr. can provide necessary medical care to a minor, but the parent or guardian is the one responsible for payment. It's one of the cases when a minor can obligate a parent financially, not based on contract, or the signature of the minor. Was the Dr. within the plan for your father's insurance? If so, they would have been obligated to bill the insurance company in a timely manner, and if they failed to do so, the insurance contract usually requires them to eat the cost.
Re: Re: Re: Re: Re: Re: Re: Re: CA Responds.... You need to reread the line where i suggested she check with her state's Age of Consent laws...every state has a legal age of sexual consent. In my state a person who has not reached their majority but has attained the age of consent can consent to engage in sexual acts but only with other minors who have also attained the legal age of coonsent...but this discussion is totally offtrack... The issue is "who's responsible for the bill" ? The underaged pt who can consent or refuse services or her parents/gaurdian? I put my money on her parents being the responsible party...but, if you know that you received the service...and as she stated it...she was only 2 weeks away from her majority...why would she not claim responsibility for the debt? "If you're gonna talk the talk...u gotta walk the walk..."

Re: Re: Re: Re: Re: Re: Re: Re: CA Responds.... I just got off the phone with the Dr's. office. She's sending me a statment of when the insurance was billed and how much they paid. Than she FLAT OUT admitted that the statement that was sent to the CA, does in fact cotain personal medical information as far as a diagnosis/description of what I was in their office for. Part of it is "coded" by the "inner office" code, but does till contain a brief written description. LMAO, so she just admitted to me that she sent a Statement of my account to a CA with personal/confidential medical information. This is just great.
Re: Re: Re: Re: Re: Re: Re: Re: CA Responds.... Are you getting your lawsuit ready yet? This is beyond credit violations!
Re: Re: Re: Re: Re: Re: Re: Re: Re: CA Responds.... Well I told the Dr's. office....."Look if I owe you I owe you, but you need to provide me with proper evidence of this..because I'm not taking this poor excuse of validation from the CA as proof. And I also said IF I do in fact owe them, AND they can prove it I will write a check TO THEM EXCLUSIVELY and personally drive it to their office. BUT, THEY WILL have to delete the TL on my CR, if they refuse to than I will speak with an attorney for the violation of my private personal medical rights!
Re: Re: Re: Re: Re: Re: Re: Re: Re: Re: CA Responds.... I hope that you will continue to post on this thread. I'd love to know how your case comes out. My concern is that when you or your parent/gaurdian signed the MD's Office consent form it probably stated in small print that your personal information could be shared with certain third parties: insurance companies, other physicians, healthcare professionals, and hospitals, etc. You might have "consented" to collections too, the same way we "consent" to collections in the case of a default. Another potential problem is that HIPPA's privacy rules took effect on April 14, 2003. Was the service in question provided after that date...or, was the alledged disclosure prior to that date? Here is a link re:HIPPA http://www.os.dhhs.gov/ocr/privacyhowtofile.htm Good luck
