CA sent letter saying they will Garnish Wages

    I just recieved a letter from NATIONAL CREDIT SYSTEMS saying My Account is being Reviewed for Additional Recovery Options such as Garnishing wages... Does this mean ill have a public record on my reports? I tried sending Pay For Delete letters but they respond with this letter. Does anyone recommend something i can do?

    Absent an actual judgment entered against you in a court of law, they really can't garnish your wages. Additionally, depending on the state you live in or where your current income is coming from, your wages may not even be garnishable. I also forgot to mention that empty threats of wage garnishment (ESPECIALLY when such actions aren't permitted by law) are a prohibited activity under the FDCPA.

    My advice, for what it's worth, is to see if your state is one of the few where wages cannot be garnished for a defaulted tradeline, and if your current income is exempt from garnishment. I know this sounds cheap, but a quick search on teh Googles will reveal the answers to these questions. I would also save the letter and hold unto it as potential evidence for an FDCPA suit in Federal Court if they decide to continue being cheeky.

    Other than that, don't panic or get upset. Normally, I'd say try reasoning with them but if their only response to your offers is a threatening letter, then the time for dipomacy or any hope of setting things amicably has passed IMO.

    This sounds like the intentionally intimidating sounding letters they send to shake you up. And it worked, apparently.

    Whether they crossed the line is hard to say without reading the actual verbage. If they just say something to the effect of "We are considering law suits, judgments, garnishment, etc." There's not much you can do. They can consider anything they want. What they can't do is threaten such actions.

    Send a DV before you start talking PFD. (Don't be in a hurry to throw your money away). Make sure that the debt is yours and that they are authorized to collect it.

    So Ur saying they're just tryna scare me? ok ill send a DV first before i piss myself. dont c y they're so difficult
