is reasonable to assume they had they them when you requested validation and they sent them to you.

That's a great question, but it seems that the customers here don't have their own account history. She said, "Yeah they sent us a receipt and history but it was not accurate from what my husband guessed he owed.

What does the OP want to have happen here? A year ago she said she planned to pay this debt. Is that still the goal? Is the dollar amount in dispute?

1*I do. I have special forms that I fill out for every account I have with everybody.
Now back to my question Whos account history applies in the event of a dispute? Mine or theirs?
2*This is why I keep my own account history on the special forms. It eliminates the guess work.

Another handy feature of these forms is I can fill them out using the creditors information from their account history.
This allows me to get a line by line comparison between their records and mine and quickly reveals any discrepancies.

When my husband was laid off he tried to get with all of the tool salesmen to settle the accounts. When he paid this guy they both agreed the appoximate amount owed but the guy was to go home and look it up. Husband paid what they thought it would be. He said that it could have possibly been $15-$20 off though. When the CA sent the bill it was over $100 for just the original balance.. There was no way it could have been since the original purchase was only $79.00. There is no way I am going to pay twice as much as the original purchase after he already paid over $50 toward the account. The receipts and account hisptory were totally doctored up. This is why I decided not to pay even though there is a chance we owed some money. They have no contract and did not validate the debt.

    p.s.

I didn't know the amount of the debt was until after we started adding up all of the payments and I got the copy of the receipt from my husband. When I originally posted I wasn't sure how much we owed and I really had no problem paying it if they would have been honest with me.

Just sent the intent to sue letter. I just went with all of your advice. I asked them to remove it per the Cass/LeFevre letter and gave them 30 days or they get the lawsuit.

I used the online certified mail at USPS. I hope it is a good as it sounds. That is so convenient for me. I hate dragging my kids down to the P.O.

    Thanks for all the help.

They sent you to collections over that?

Update on this one for you guys. I sent the letter referring to the Cass-LeFevre opinion. I sent it CRRR so I know they got it over a month ago. I disputed it a few days later. Anyway I never got a response from the CA and just received investigation results. It was deleted so I am assuming they knew they were out of luck.

Score for us. Thanks for the advice. It worked.
