I was online getting the registered agent for American Agencies in California. When I found it, there is numerous items listed, such as, date filed? (I am assuming for licensing), corporation #, and status. Under status, it said "suspended". I looked this up under the terms and it says "The California corportation has lost all rights and powers for failure to meet statutory filing requriements of either the Secretary of State's office or the Franchise Tax Board." What the heck does all that mean? Anybody know?
That sounds like it means that they can not do business in California. More than likely, they got caught doing something illegal, and the state terminated their license to do business with the state; or they entered into a settlement to stop doing business in the state. Either way, it sounds like they're in major trouble if they're doing business in Ca after the date their license was suspended...
Wouldn't that mean that they can't report to the CRA's? When you quit, you lose! gmaof1 ================ I would think so. But then again nobody seems to know the answer to this question which I have asked many time. The Question is. Is a person legally obligated to pay a debt to an illegal enterprise? Another way to put it is can an illegal enterprise even create a legal debt. THE END ** *** ** LB 59 """"```--~~~~~~~~~--```'""'''
The Question is. Is a person legally obligated to pay a debt to an illegal enterprise? Another way to put it is can an illegal enterprise even create a legal debt. Bumping for answers /comments on the above question.
I called them yesterday. It was quite obvious that nobody who I spoke with had any idea what I'm talking about. Any more suggestions?
1. What about a bankrupt creditor covered under FDCPA? 2. Are they allowed to continue collection activity during their bankruptcy and after the liquidation of their company to another? 3. Would the company that acquired the accounts be under any obligation to disclose during litigation or even after judgment that they are the actual creditor now? so many questions...so little time!
Not to pee on your parade right now but check this out... I was on my states site for this type of thing. www.mi.gov/somthin... There you can type the name of the business and see if they are licensed. I did this with all the CA's I know of on my reports and a few came back "nothing on record". But this could mean they are under a different name is all. The point I am making to you is this... Another couple of them said their license was suspended or past renewal. I thought that meant they were conducting business illegaly. I checked further and in just about every case, they had themselves covered because under a slightly different variation of their name, or if more than one name popped up for that search, everyone one of em was currently licensed. You may see that they were unlicensed at one point. But they more than likely have been re-instated for their license. SnakeMan
I ran a Secretary of State search. There is an American Agencies General Agency, Inc. that is listed as active. You may want to make sure that this isn't your CA. I saw the other entries for American Agencies and they were both listed as "dissolved". One was dissolved in 1987; the other in 1922.
