CA used old last name?

    You have done a spectacular job if any newbie passes by. They will not think our best advice is to bury our heads in the sand and not pay any bills, for seven years!

    Do yourself a favor and give it up now. I was in a similar conversation with this poster a few months ago, and the arguments just got stupider and stupider.

    It is obvious from your previous posts that you donâ??t know what you are talking about so if you wish to continue to give BAD advice go ahead! I am just telling you that if I see your GARBAGE posted that I am going to call you on it. It is not fair to the people who come here looking for REAL answers to have to read your bad advice over and over again.

    You do not need to try to â??convinceâ? me that you know what you are talking about because that is NOT going to happen until you put a little time and effort into really trying to offer people solutions to their troubles.

    You keep saying I don't know what I'm talking about but you won't tell me what I did wrong. My 7-year plan worked for me.

    Yes, I buried my head in the sand, no I did not pay my creditors, yes my credit is now excellent.

    What's the problem?

    jlynn is right. I'm new and I want to do things the RIGHT way. That's why I'm here asking how to handle this. The last thing I need is to make things worse or dig myself into a deeper hole.

    OK, I'm going to use the same name they (CA) used.

    Thank you all for your comments & suggestions. I'm still going to wait a while before I send off my validation letter, since my 30 days is still running.

    If and when you sent a validation letter, did you also send the credit disclosure statement with it?

    Until they here from you, they are free to continue collecting, and free to ding your credit report.

    Yes send the sample letter just like it is.

    Okay, I'm confused. If this debt is 10 years old, isn't the SOL up on it and whatever name is used would be irrelevant? I'm not sure why it matters if the CA has the correct name in reference to debt they can't collect on. Am I missing something?

    Ash, if the ding your credit report, the only way they could do it would be to reage the account, which is illegal.

    I'm personally the type that doesn't look for trouble and violations - don't want the headaches. So, I would send it off soon.

    Please give more details on the debt this CA is after. Non judgement? From 10 years ago? I'm a newbie, but I'd say you're stylin'. Please update ;)

    Quick overview on my story...(deep breath)
    OK, 10 years ago I got divorced and had a mail order catalog account. Bought a few things and then lost my job and had to move. Well, as soon as I moved my name changed. My credit was crap, I never applied for a credit card because I couldn't even buy a car on my own. Anyway, I neglected this bill, as if it never existed. This was easy to do because I wasn't even 20 yet, and the catalog company never found me because I don't (honestly) remember getting anything from them. Well, like I said, it's been 10 years. Life goes on and again my name has changed because I remarried. My husband and I refi'd the house not too long ago, and to both of our amazement, the loan officer said my credit looked great. So, I figured that time healed everything. A few short weeks after, I received the letter from the CA...addressed to me in my old last name but they had my new address. They CA say's they just bought this account and want to collect...30 day's to respond...blah, blah, blah. The state where the debt was accumulated in, the SOL has expired, and it has expired in my present state. In my original post I asked if I should tell them that the SOL has expired and leave me alone, but then was told I should validate first, then tell them if and after they respond that the SOL is up.
    So, which name would you use?

    OK, now I am feeling really anxious about all of this, again. Now that I thought the thing to do is first validate, then tell them the SOL expired if they contact me again, and I wanted to know whether it's alright to sign my old last name, because I figured they didn't have my current name since they didn't use it and I don't want them to use it. What do I do??????? Aarghhh.

    Okay, here's my guess (the experts can either back me up or tell me I'm crazy) . . .

    The debt is uncollectable. I would write a combo letter to the CA informing them that:

    **The SOL has expired on this debt
    **If they proceed with any collection activities on this debt (including, but not limited to reporting to the CRAs) you will sue them
    **Do not contact you again regarding this matter

    I see no point going through the effort of validating the debt. If it would, however, provide you with a degree of comfort going this route, I think that you will end up in the same place.

    In terms of which name to use, since they can't collect on the debt, I wouldn't worry about it -- choose whichever you feel most comfortable with.

    2) You are FINE!!! As Merlin said - the debt is uncollectable. If you sent a validation letter already, all you've lost is the CCCR $$.
    3) Is this showing on your report? If it is, and continues to, you're on your way to getting that CCCR $$ in spades.

    Since this account is so old you DO NOT have to worry about ANYTHING. You could ignore the letter. If they send another letter you can C&D them this will shut them down in their tracks (you could do that now if you wanted).

    If for some reason (I doubt this would happen) they pull your reports or place a collection account on your credit report then you would have VIOLATONS that YOU could sue them for.

    As far as the name goes my advice is STILL the same if you do send a C&D to them use the name they have. With the debt being out of SOL the ONLY way they will get your current info is if you give it to them or they pull your report ILLEGALLY. Donâ??t worry about this CA they are a NON- ISSUE.

    Here's the deal, Diva,

    That debts are removed from reports in 7 years is the only reasonable and responsible thing you've posted.

    It is no secret that debts are removed in 7 years.

    However, if we were all into hiding for 7 years, there would be no need for this website. So I'm not sure why you feel the need to keep repeating what we all already know.

    THAT you have good credit NOW without addressing it, only means that you too will eventually need to figure out how to properly address and deal with your financial responsibilities eventually.

    No worries though, you'll have good credit again in another 7 years.

    Ash, have a glass of wine. LOL you are driving yourself crazy.

    If you were to search around here, one piece of advice from the veterans was to opt out of PRM inquiries before seeking a mortgage. Some how or another CA's get info on people that have applied. Time and time again, people have come here just before closing to find some CA has crawled out from under a rock and planted themselves on your cr.

    This sounds a bit like your situation. Something in your refi process woke these people.

    Here's my advice, and take it for what its worth - I have not dealt with a collection out of SOL. One rule I have learned here is never play your hand too soon to a CA. You let them know it is out of SOL and they may come up with a way to re-age the account, which will create more headaches for you.

    If you dispute and request validation, they have to go back to the OC for copies of original documentation to prove you owe the debt. They cannot continue collecting from you. They have bought an acct for pennies on the dollar, and they are looking for the rollover who doesn't know their rights and will payup for a quick profit, and no effort on their part.

    IMHO, once you send the validation letter, using your old name, you will never hear from them again. They can't continue collecting, and dollars to donuts they can't validate.

    So, send out the validation, sign your old name, and have that glass of wine. If (and that's a big IF) you here from them again, someone here will walk you thru it.
