I sent a validation letter to Risk Mgmt's Duluth GA location in Oct and they signed for it on 10/29. In my letter I requested they never call me, communicate only by mail. I haven't received anything from them so far. Tonight I got a recorded message on my answering machine claiming "we have an important business matter to discuss with you, call Ms. so and so at ....blah blah blah". I called and sure enough it was Risk Mgmt. She told me her computers were down and she could not look up my account. She said she was in the New York office and they are separate from the Georgia office and would have no knowledge of any letter I sent them. This sounds like BS! The TL on my CR gives the Georgia address but a recent letter came from New York. I am positive both the TL and the letter are for the same account. My questions are: 1. Does it matter whether the validation letter was sent to GA or NY address? 2. If the answer to #1 is no, are they in violation of the FDCPA by contacting me by phone after I specifically asked them not to? Nivvi
This is why you NEVER let them sucker you into calling them. I get these calls, too. I ignore them. If they want to communicate with me, they can do so in writing. By the way, I may be wrong here, but I don't think they can really claim ignorance on this. But if you want to pursue something against them, you will have to have some kind of proof (i.e. recorded phone call, if your state allows it)
I agree with you 100% Buck and normally I would not call them, however the message on my machine did not leave a company name, so I wanted to see which CA was calling (I sent validation letters to several CAs). I was glad they called, cause if I have evidence of violations from them, maybe I can get them to remove the TL. I think it is illegal to record phone conversations in my state (GA) unless all parties are aware of the recording, but my husband is a witness to the acutal message being recorded. What about a three way call? Is it illegal in GA to have a 3rd party listening if the CA is not aware of it? I could call them to confirm they are the ones leaving me messages while my husband listens in. I would not discuss anything with them about the account or the dispute I sent them. Just let them do enough talking and maybe hang themselves....any thoughts on that?
