To answer the question from The Kid (and other of the board), The CA never contacted me about this debt before entering it on my CR (that's a violation right there, correct?). When they originally entered it on my TU report in March of this year and I sent the validation and then estoppel and it was removed. The only correspondence I got at that time, was a letter (on their letterhead) stating the acct originated from YourBank.com (never heard of them) and it stated the amount. This obviously is not validation in my book and I've treated the letter as never received. It's a blatant violation for them to have entered this on my EQ report and because they're giving me such a hard time and not taking it off in spite of their violations, I'm suing for deletion and $$$. ps. HAPPY THANKSGIVING!!!!!!! pps. Once I receive my small claim forms from US District Court of Maryland, I'll probably be posting to ask a few questions, so bear with me. small claims and District Court are two COMPLETELY different types of court. I would also suggest reading the lawsuit faqs by Marie, LK, and others. Those are a good starting point. Also do a search on "Plaintiff"; on Psychdoc's "10 minute lawsuit"; on "Christi" 's "lawsuit" for motivation. Check on other templates on www.bayhouse.com and Whysper's www.proselitigant.com
I think I may not be remembering the name for the Courthouse correctly. I believe that's it though..I know that that's where I had to call to get the small claims forms.(Any residents of Maryland here??) IMO, the CA does not have to contact you prior to reporting the tradeline to the CRA. Good luck w/your suit, do let us know how it turns out.
I looked at Maryland's court pages, and it looks like Small Claims falls under the umbrella of the district court there. I'm sure when you go to file, if you're at the wrong place, they'll let you know ;-)
