    Dh got a letter from our friends at MCM ...Wants us to provide them more information from our records on this alleged debt from 1996??????

    Go Figure!!!!!

    HELLO........................................... That is Why We Sent You ...The DV LETTER!!!
    You Are ...the one putting the adverse TL & Verify every time we DISPUTE !!!!!!

    I bet it would help them if you sent you original signed contract and a copy of your driver's license. If you really want to help send a voided check so they can garnish your account. LOL. I wonder how many people are sucker enough to send them anything.

    I think it is company policy for Midland to send out letters like that so that they can keep the clock ticking for a few more days.

    Speaking of MCM, I came home from work yesterday to a message on my answering machine:

    "This is so-and-so from MCM, we received your validation letter today and I just wanted to ask you a couple of questions. Please call me back at....."

    So what do I do? Ignore, right?

    How about this - if their TL is still in your CRA file and has been re-aged, just sue them for the FCRA violation. It's a sure bet they don't have the documens to sue you or they would have by now, so extorion by holding your FICO score hostage is their only remaining weapon.

    Sue the bastards and let the Judge sort it out.

    Did NOT send the C&D, I figured they'd take the "no more collection attempts" from the DV as a pseudo-C&D. Guess not...D'OH!!!

    Should I send that now? I really have no need/desire to talk to them for fear of saying something stoopid.

    Be careful when you C & D...from the FDCPA:

    (c) CEASING COMMUNICATION. If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, except --

    (1) to advise the consumer that the debt collector's further efforts are being terminated;

    (2) to notify the consumer that the debt collector or creditor may invoke specified remedies which are ordinarily invoked by such debt collector or creditor; or

    (3) where applicable, to notify the consumer that the debt collector or creditor intends to invoke a specified remedy.

    C & D leaves them very few options except to sue you. I always include in my validation letters to contact me only in writing.
