Calif Franchise Tax Board liens....

    I'm not sure where this is going... if it's an FYI or questions.

    I have a FTB released lien and my understanding is that it drops off in 7 years.

    I called and spoke with the FTB on Friday about 3 liens that show up on my DH's record - but not mine.

    Ok... it's going to be both.... FYI with two questions.

    First, on their site, it states that some tax liens may be released if included in a BK. Since it was my DH's she wouldn't be specific when I asked the rep. but she did say that yes, if t's a zero asset bk, then the lien is released.

    She also went on during our conversation and mentioned that they don't keep ANY of their records, that all is turned over to the county recorder. I asked VERY clearly, "You don't keep ANY record??" and she said, "that is correct."

    Question 1:

    If a lien is on a 1995 filing, and they don't lien it until 1999 and the bk is in 1998, would it still be covered under the bk. (I know, I should have asked her) My thought is that it's when the lien was filed and not when it was incured. Comments?

    Question 2:

    When you challenge a record, the validation has to be with the original provider of said data. Can the CRA rely solely on the country recorder's office (which is what they seem to do) OR does it have to be verified with the Calif. FTB themselves?

    Assuming that it comes back verified, I could challenge the procedures. Is this a "too good to be true for us?" (ok, that sort of makes it 3 questions)
