california BK Laws??

    has there been any new laws in filing??? My mother needs to file. she is worried that she can't because she has had money in a account that was not hers. Help. She is on Social Security and now does not have the monies to pay credit cards back, she also was charging up until about a month ago thinking she was okay, but things have changed. should she tap her cards out??? Can anyone help with there 2 cents.....

    Unless you're talking tens of thousands of dollars or more, the BK court probably won't be too interested. If she doesn't have assets (excluding home, car, clothing and other items protected under BK laws) sufficient to pay off her creditors, she should be OK in filing and getting a dishcarge.

    we are talking about 10,000.00 no assesetsm no home it's just herwith no income other than here 150.00 of social security.

    what assests can a person have, bank, car, etc....
