I faxed over to Sherman my intent to sue letter and low and behold I got a call from a Gress Hickman, he tried to tell me that Sherman is not in violation of the FDCPA because it does not give a time for them to send me the info to validate this debt, he also tried to get me to admit that it was mine I TOLD HIM NO NOT MINE he offer to delete but no money told him sorry but no, did not tell him that I have to CMRRR signed over the past 75 days asking for validation so I have them no matter what he says on not reporting it as in dispute with the CRA's also have copies of each report dated 40 days after I sent validation letter and nothing shows on there trade line that I had disputed it. he made and offer of delete and money and I said I would consider it, he told me he would clear it with his bosses and get back to me, he ask for my address and I gave it to him should have told him u got my letters it has it on it , I think they r gonna try and send me some kind of validation and try and get around it as he says that the FDCPA does not state that it has to be done in 30 I just let him talk.
There is nothing in the FDCPA that says a ca must validate in 30 days. The only mention of 30 days is in the initial letter they send you that says you have 30 days to dispute the validity or they may assume the debt to be valid.
