I was hoping to hear from jlynn about her ongoing saga with AmEX. After reading your posts jlynn, I see that I am in a similar situation with Am Ex. I think you said that your CA is Nationwide. Is that correct? That is who is harassing me. I was wondering if you ever came to any resolution with AMEX. Did you get a settlement? Also, I think that you said that this charged off in January 2002....so I assume that you never got served papers for a lawsuit or anything. Correct? My account is much larger than yours and I am scared to death. The account was just sent to Nationwide last week. So, I am trying to figure out how much time I have to save up a settlement. Also, I assume that you sent a C&D to Nationwide. Did they leave you alone once you sent that? Also, I woudl love to hear from others with similar experiences with Nationwide and AmEX and to be more specific....what kind of success you had with settlement.....thanks.
Yes, my CA was Nationwide as well. I did send them a C & D, but as Bill Bauer has pointed out before, this can be a dangerous move. I made it perfectly clear in the letter that I wanted them to C & D because they could not legally collect in my state. I said nothing about dispute/validation, etc. I also sent a copy of the letter to Amex. Nationwide signed for the letter on 2/3 and I have not heard another peep out of anyone. My balance is a little over $2,000, and no they haven't attempted to sue me yet, but I understand that they do sue. I am waiting for my settlement check from Home Depot for no PP, and that will be enough with what I have to cover the full balance. I haven't contacted them, as I would prefer to have the money in my hot little hands before I even begin. I will try to keep everyone posted. If I were you, I would go ahead and start validation with Nationwide, and hopefully that will hold them off for a while, while you save up for settlement. Good luck!
Thankyou jlynn.....this really helps. Also, how long has the account been with Nationwide? Just trying to figure out how long I have to save up a settlement. Also, I told Nationwide that I wanted the account to be validated. They told me that it does not keep them from calling me and collecting on the debt. Did they try that with you? I just want them to stop calling me, but I don't know if the validation will do that. One more thing....what state are you in? Stupid question.....where did you go to find out that they cannot collect in your state?

The account had not been with them long. The first thing I always do is check to see if they are bonded in my state (TX). I checked with the Secretary of State. You will need to find out what the requirements for 3rd party debt collectors are in your state. Some don't require any licensing or bonding. "They told me that it does not keep them from calling me..." I smell $1000 +++ Here's the excerpt from the FDCPA. Yes, the validation is supposed to stop them. Let them keep calling. Go out and buy yourself a phone recorder, and check whether you are a one-party or two party state. (b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.
