    First, I will be sending the original Nutcase. Then, This letter next, if I have no response within 15 days. Many thanks, and I'll keep you posted of the results.

    The nutcase letter series is designed for fully-paid accounts which were at one time very past due (goal: to have them remove the nasty tradelines from the CRA reports).

    On the other hand, Lizardking's fine work is intended for debts that are allegedly outstanding but have not been sufficiently proven (a.k.a. validated). His goal is to erase the alleged debt as well as have it removed from CRA reports.

    I wouldn't mix them up. Ask yourself: "Is this debt fully paid?" If no, go with a standard validation sequence (validation, estoppel, many of the variants provided here so wonderfully by Lizardking, LKH, Christi, Marie, and several others). However if the debt is already paid, and your goal is only to clean up your reports, that takes a different strategy -- in that case, you'll need to become a royal nutcase pain in their rear, and the nutcase sequence aims to help you do that.

    I came to Creditnet today to specifically look for a letter and wouldn't you know. The letter attached to this thread was it. Creditnet is always on time. Anyway guys I need some help on sueing this Creditor.

    I had a loan out with this shady loan company named Sunbelt Credit back in my dummer days in 1995. I filed BK7 1/1996 and included them. Last December they've updated 2 of my reports to read that this was a chargeoff and a closed date of 10/2001. I wrote them an appropriate letter and I did a dispute with the 2 CRA's. TU comes back with Included in BK7 but it still has 10/2001. That would make this thing drop in 2011. My credit should be immaculate in 1/2006. I plan on sending this intent to sue letter as soon as I can get the certified mail reciepts. Here's what I need help with....

    Ok the Original place I did bussiness with them was in Oklahoma. I live in Georgia now. I know they have some type of office in South Carolina because on one of my reports there is a South Carolina Address listed. That city is 4 hours away from me which would be no problem to drive to "twice".

    Reading old post here I see I would need to sue them in a city that they do bussiness in? Right???

    Anyone know anything about the South Carolina Court system. Since I will have to take a little trip to square this up I want to get this right without have to make unnessesary trips?

    Anyone who can help please chime in. I need some guidance in this matter. I'm also aware that I need to get the other reports to see what they have done. Thank you.

    I want to add this because this may help if anyone knows the area.

    The company is located in Spartanburg South Carolina. Using the google search engine (deep meta) it seems that eveything in the damn town is named Sunbelt.

    Do these guys own the city or is Sunbelt one of those "common adopted names" for the city bussinesses?

    Help guys I got to get this off of my reports soon.

    Mr. Fat Jake, read a little further. That might have been my post that mentioned suing in the place where they do business. One of the many knowledgable creditnetters responded:

    If they pursue you where you live. . ."THAT'S" the place in which they do business so you can bring suit against them in 'your' local court. Go to the FTC.gov site and look under FDCPA. Find the 'Jurisdiction of courts'. It should say something like. . .An action to enforce any liability created under this title may be brought in any appropriate United States Dictrict court blah, blah, blah.

    Thanks Keller. I think that there is a gray area though since they have only reaged the debt and not contacted me.

    I did a search and found alot of post where people went to small claims court and the court refused to file the complaint.

    Believe you me I don't want to drive the 4 hours to S.C. but at the same time I have no "job" right now to stop me.

    My first step would be to get the certified mail reciepts and then send off this letter.

    I'll post some updated later.
