Ok gang, Here's the deal , last year Best Buy sent me to collections after being late, Im not sure if they sold it or assigned it. Since I was contacted by a CA , I stopped paying BB even though they were sending me statements as well.. During that time, they have been reporting me late, each and every month. I had started paying them again, after getting caught up on all my bills and now I have an acct with their CA as well as them. When I started to read this board, I figured It would be in my best interest to call the CA and ask for a deletion for payment, hence I didnt send my monthly payment in to best buy. I just received invoice in mail stating that i am past due again, they have assigned a late charge fee and finance charges... Please help me, Im confused. Can they have a CA collecting at same time, do they still have the ability to keep reporting late and can they still charge me finance charges as well as late fees? What should I do? This acct is killing me with all the lates!! I can and will pay it, but want to do it the best way possible for my CR...thanks for any advise in advance.. When I call best buy they forward me to the CA??
i believe you can still accrue late payment charges, interest, etc until the account is charged off. is it their internal collection dept calling you or a 3rd party? i would call best buy and tell them they will not receive a payment until it gets straightened out and those payments not made had better not be reported as being late, as it sounds as though they are double dipping. if the account has been sent collections then they need to discontinue sending you statements and vice versa. they cant have both. i wonder if your account was sent to collections when you weren't paying, and then when you began making payments they didn't notify the collection agency to discontinue collection.
When I call Best Buy and put in my acct #, it just says this account is being handled by Corporate REceivables..please contact them at, blah, blah, blah.. I just tried to call BB, there Customer Service Department is not open until Monday..will have to wait until then...
double Dipping, that is what Im thinking. And also, Ive been mighty confused as to who Im supposed to be paying. Would it be reasonable to call bb and state that they have been "double dipping", and that due to that reason I would like all my late and collection data called back. I would pay the debt in full if they went for this. Anybody think it would work? To anyone's knowledge is there a technical term for double dipping or does anyone know if this is wrong for them to be doing this??
Re: Re: Calling Today..please read..thanks! Haven't seen this as a technical (legal) term, but I believe it could be referred as a "billing error", especially if you receive statements from two companies about the same debt. P.S. We finally agree on something, jenz ...
Re: Re: Calling Today..please read..thanks! * Of course it's wrong{illegal} for them to collect twice for the same debt.
Re: Re: Calling Today..please read..thanks! no vghost you are 100% wrong - the actual "technical" term is "double dipping"... KIDDING - just couldn't help myself. now, let me see if i have a case law i can quote on that technical term.......
Re: Re: Re: Calling Today..please read..thanks! Well, I didn't say "there is no such a term", I said "I haven't seen" ... The good part is to always be able to have some fun after all the discussions and arguments!
Re: Re: Re: Calling Today..please read..thanks! UPDATE: I called Besy Buy today and inquired about my situation, stated that to my knowledge both entities could not collect and how can they be charging me late fee's?? I played dumb consumer and offered to pay in full if they would just remove the derog. info off of my credit report since there was so much confusion. Get this ..best buy would not take my payment, said they had been billing me in error and to disregard the late fee's and the balance on my invoice. She told me to call the assigned CA and pay them. I then asked what my balance should be if I was to erase all their erroneous late fee's and she told me that she didnt know and to just pay the CA was they were asking?? WHAT????? Today, I recieved in the mail an invoice from the CA stating that this was the last time they were contacting me. I could either pay the balance in full for a 20% discount or pay 10% of the balance each month.!!!! Since Best Buy wouldnt take my money, by the way, their invoice said I owed 432.74 and the invoice i recieved from the CA states I owe 292.55.. it is being reported on my CR as 396.00 and 120 days past due?? Everything is so screwed up on this, I dont even know where to start?? Any advice, Im sorry for this being so long..I just want all the late and collection info deleted and am willing to pay for it?? What is my best route?? thanks for listening..!!
Re: Re: Re: Calling Today..please read..thanks! Just called and the woman at the CA stated that they could not take derog. info off for payment..that it was against the law. I stated it was against the law for them to report incorrect information, etc. I told her that I had no incentive to pay the bill in full then at that time and she said" I dont care, dont pay it then, it's your credit, laughed and hung up on me..."...............arghh!!!! I hate this stuff. They are so damn mean.
Re: Re: Re: Calling Today..please read..thanks! This is why you DON'T talk to them on the phone. You write them, then you have their responce in writing ...
Re: Re: Re: Calling Today..please read..thanks! At this point sweetlevl, I would send in a validation request to the CA........especially since the OC has said their have been billing errors. In the cover page, I would request CA to delete the alleged account as the OC has agreed there have been substantial errors related to the alleged account. If the CA was unwilling to delete, then please comply with the enclosed validation request. XXX 20, 200X Re: Your nameâ?? Account Number xxxx Collection Account for xxx creditor, $xxx To Whom It May Concern: I hereby dispute the validity of this alleged debt against me. Please provide 1) the document with my signature, agreeing to pay this alleged debt. 3) itemized accounting to substantiate the alleged balance. 4) copies of documentation of date(s) I was notified of the alleged debt including addresses to where notification was sent 5) the agreement with XXXOriginal Creditor that grants you the authority to collect this alleged debt. 1*best buy said they had been billing me in error and to disregard the late fee's and the balance on my invoice 2*she told me that she didnt know and to just pay the CA what they were asking. 3*Today, I recieved in the mail an invoice from the CA stating that this was the last time they were contacting me. 4*I could either pay the balance in full for a 20% discount or pay 10% of the balance each month.!!!! 5*it is being reported on my CR as 396.00 and 120 days past due?? 6* Just called and the woman at the CA stated that they could not take derog. info off for payment..that it was against the law. sweetevl =================== 1*So then there is no debt. 2*Now why would you have to pay the CA anything on a zero balance? 3* Don't you wish? 4*Ok send them a money order in the amount of $0.oo as payment in full. 80% of 0 is zero. 5*How can you owe 396 on a 0 balance and be late on paying it? 6 The CA lied about this. --------------->> >------------------------------------------------------>> PS; This is pretty neat. The OC sold the CA a debt with a 0 balance on it so the CA can collect hundreds of dsollars on it!
make sure you file a compliant w/the better business bureau about your phone call. if months down the road you go to court to sue, you'll have it documented on thier "harassing" and "deceitful" behavior - each worth $1k. worked for me. holy crap - did i just say that?!?!?!!? WHAT ARE YOU GUYS DOING TO ME.........
Hi gang, I tried to fax a letter to Best Buy Corporate today with documentation of the whole event. First names , Last names, you name it , I documented everything and put it in writing. Let's just say it was my version of the nutcase/goodwill. I demanded that they contact me within 30 days or I would report them to the BBB for unfair collection practices as well as the FTC. BTW, the fax didnt go through (surprise?)so I am sending it CRRR tomorrow with attn to the legal dept/cutomer relations mgr. Should I give them the 30 days or report them to BBB right off?? Do you think I should send a verfication to the CA at the same time?? I dont care to pay this, it is a debt I owe, that I was late on. I just dont think they should be able to do what they have been doing and am going to use that to get the derog. info and their mistakes to my advantage. Plan: 1.) send letter to Best Buy Corporate Headquarters CRRR 2.) send validation to CA as well CRRR 3.) Pray that it works?? What do ya think? I think I have a case, but Im still a newbie, need advise from the gang!!
