I was wondering if a CA can pull get this TWO Hard Inquiries in Consecutive days on you when you've never, ever received anything from them? I was amazed when I got the CRA alerts thaty inquiries were made, when I saw them I was like Whatttttttttttttttttttttttt. They pulled 2, this morning I was going to call to SCream. They somehow called me. I asked what the F**K. They told me We can Pull Hards, And told me they were collecting on a debt that was charged of 3 yrs ago, Which had no communication or collections eforts since then. She wanted me to make arrangements, which I told her I don't know who you are, please send this in writing and be aware this is the first communication that I've got and you pulled my bureau. "So if I send you something that means your're going to pay this debt" I said Ma'am please send me my information please. Well I also can Fax it to you.. NOOOOO Send in writing. Someone please shed some light on this for me, plus they are working on behalf of another CA which has a ugly track record and they pulled a Hard on another of my CRA reports which I noticed... Oh these two hards lowered my credit score by 15pts also!!!!!!
If they have permissible purpose to pull your reports, they can pull them, regardless of whether they have first contacted you. Permissible purpose includes collection of a debt. Repeated hard inquiries specifically to poison your reports might be actionable, but you would probably have a stronger case if you have disputed and requested validation of the debt under FDCPA within 30 days of their first contact. Since this is their first contact, they should notify you in writing of your dispute and validation rights within 5 days. When you receive that letter, and even if you don't after about 10 days, you will want to then send a letter disputing the debt and requesting validation. You don't just want them to send "something", you want them to send validation obtained from the original creditor. If it is your debt, and it is within SOL, you may need to deal with this.
Yes it was an old debt which was mine, but the OC made a agreement with me, I sent Two checks to avoid charge off, they cashed checks and I later found they charged off anyway( it was in process of charging off, but OC told me to avoid this send two check) I later disputed on agrounds of bait and swtich. I never heard anything again til 3yrs later Now. If I'm stuck I have no problem negotiating a settlement. Equally would've been willing to do with this CA, but they haven't given a chance and those 2 bureaus back to back to me is trying to hurt me? Especially when the other CA involved pulled already one on another bureau.. So I will dispute, I really want my score back up 15pts, cause i will deal before this CA trys to slap on my bureau. So my angle to negotiate settlement and removing of the extra Inquiry?
Did they agree to consider it "settled for less than full"? If so, they should not have sent or sold it to a CA, but they would have been able to report the balance as charged off, with $0 balance due. What type of debt is this?
No they didn't agree to settle. They just agreed to Bring it current out of the past due Charge off stages, which is why the 2 post dated checks were sent and cashed. The account was a credit card. I want to get it deleted, but somehow I don't think the CA will be able to negotiate a removal totally off from the OC. My Complaint is the fact the freaking bureaus pulled back to b ack days. I was given a verbal agreement, that If I sent in 2 checks that brought the account current, the account would be fine, as aforementioned the account was still charged off. I called and screamed at the false promise, a woman told me the account was in the process of w/o at that moment, but the rep should've told me or given that promise. I said screw that she did, you took the money, cashed the checks, I should've been told, i'm sorry the account is already in the stages of write off, don't send any money. A few months later a CA tried collecting. I sent validation and synopsis of the scam promise. I never heard anything again from them or the OC, now they've obviously sold to a new CA 3 yrs later.
