I disputed something with OSI. About two weeks later, it was deleted off all my credit reports. About a month later, it was put back on all three. I got a response from OSI about two months after I disputed - it was a copy of a contract without my signature. It had been signed by the salespeople at the furniture store, but not by me. When something is deleted from a credit report, do the CRA's have to give notice to re-insert? (In other words, OSI requested that it be deleted - but then OSI had it re-inserted.) Do the CRA's still have to notify me?
Re: Can a CA re-insert w/o notice? I believe they have to give you a notice (from the CRA) when they do that with five BUSINESS days notice. Do you have hard copies of the reports? When it was on, when it was deleted, and then again when it was put on again ? Hopefully others will answer this who have a little more expertise than I do. But if they did not notify you - I believe you have a violation. Any one else? Mommy2cats

Hi As far as I know, CRA only has to notify you that it is back on there if you requested an investigation from them and the CRA's deleated it then reinserts it.....I am in an similar situation and remember by having the CA put it back on your report I would think that is continued collection activity...which is a violation Jamie
Re: Can a CA re-insert w/o notice? The CRA has 5 days from the time of reisert to notify you. Look over the FCRA for this. It really is the responsibility of the CRAs, not the CA. I would send them a copy of your reports with the item deleted, remind them of the guidelines under the FCRA, and demand deletion. Send CRRR.
Re: Can a CA re-insert w/o notice? Well, the way it happened is - I disputed it with TU and EQ - and they sent a response saying it was no longer on file. That is because OSI deleted it. Then OSI put it back on. I know what the FCRA says about re-inserting - but the question is - if OSI deleted it and then put it back on - does the CRA have to notify me - or is it only if the CRA deleted in response to a dispute that I have to be notified? I know this is confusing, but I really need to know. I am trying to get as many violations on them as I can especially because they are trying to collect on something that I DID NOT BUY. They sent me a copy of an installment contract that does not even have my signature on it!!!
Re: Can a CA re-insert w/o notice? If the acct was deleted as a result of the dispute, then yes - the CRA needs to notify you within 5 days. It doesn't sound like this is your case though.
Re: Can a CA re-insert w/o notice? tmitchell is correct regarding CRA re-insertion. However, I would go after OSI. The same thing happened to me. It was originally listed as Gulf State, then re-inserted as OSI. I called EQ and they said Gulf State/OSI re-reported it to them. I would send the Estoppel to a Mr. Samuel Shannon(you can do a search, I posted his contact info once before). This will get you an immediate response. Just state that you have not recieved validation and that they have committed a violation by re-reporting(considered continued collection activity) this trade line.

(B) Requirements relating to reinsertion of previously deleted material. (i) Certification of accuracy of information. If any information is deleted from a consumer's file pursuant to subparagraph (A), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. (ii) Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 BUSINESS days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency. (iii) Additional information. As part of, or in addition to, the notice under clause (ii), a consumer reporting agency shall provide to a consumer in writing not later than 5 business days after the date of the reinsertion (I) a statement that the disputed information has been reinserted; (II) the business name and address of any furnisher of information contacted and the telephone number of such furnisher, if reasonably available, or of any furnisher of information that contacted the consumer reporting agency, in connection with the reinsertion of such information; and (III) a notice that the consumer has the right to add a statement to the consumer's file disputing the accuracy or completeness of the disputed information. (C) Procedures to prevent reappearance. A consumer reporting agency shall maintain reasonable procedures designed to prevent the reappearance in a consumer's file, and in consumer reports on the consumer, of information that is deleted pursuant to this paragraph (other than information that is reinserted in accordance with subparagraph (B)(i)).
Re: Can a CA re-insert w/o notice? The same thing is happening to me right now. Is Gulf State and OSI the same company? They are using the same ID number. Do they get around the 5 day notification if they are the same company but use a different name? ARgggggh!!! Why do they keep playing games, can't they just do it correctly? CBJ
