X-Post from creditboards.com The letter pretty much explains the situation, but the gist is EQ verified without actually hearing back from the OC. They re-investigated in their internal system again after not getting a response and kept the account in dispute past the 30day window. I have their results letter which says verified, and also the included copy of my updated CR which still shows the TL as 're-investigation in pregress' Dear Sir or Madam, Your failure to follow appropriate procedures and insure the accuracy of the credit information you report disheartens me. On 09/16/2003, I disputed the accuracy of an account you report on my credit file with you via your website. The confirmation number for that dispute is: XXXXXX. Per the FCRA, you have 30 days from the receipt of my dispute to verify the accuracy of said item. § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i] (a) Reinvestigations of disputed information. (1) Reinvestigation required. (A) In general. If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer. (5) Treatment of inaccurate or unverifiable information. (A) In general. If, after any reinvestigation under paragraph (1) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or cannot be verified, the consumer reporting agency shall promptly delete that item of information from the consumer's file or modify that item of information, as appropriate, based on the results of the reinvestigation. On Wednesday October 15, 2003 I received the results of your â??re-investigationâ?? and an updated copy of the credit file you maintain on me. Your results indicate that you successfully verified the account for XXXXX with Account #: XXXXXX. However; my updated credit report shows the referenced account listed with the comment â??Consumer Disputes â?? Re-investigation in progressâ??. It is obviously impossible that this account was verified; as your re-investigation is still in progress. Pursuant to the above information; you are reporting inaccurate and non-verifiable information as accurate on my credit file which is a violation of the above FCRA statute; and as such I demand that you delete the above referenced account immediately. Your failure to do so will be construed as a direct violation of the above FCRA statute, an act of fraud, and a malicious effort to damage my ability to secure credit. Also, I will have no other choice but to file complaints with my States Attorney Generals Office, the Better Business Bureau and most importantly with the Federal Trade Commission. These complaints will of course, immediately precede my filing suit against your company. THEE ONE XXX-XX-XXXX City-ST-ZIP
