Sometime this week I will be calling a law firm hoping for a settlement. The situation is that the NAF awarded FIA/ BoA. The court papers seeking a judgement were delivered to me last week and after much consideration, I have decided I would like to settle--if the DC/law firm will deal. I am pretty sure that the OC is the plaintiff, so stated by the court papers. Unless the lawyers will not deal, I would like to settle---for much less than listed in the court papers.

So should the OC's lawyer agree to a settlement, I would like to have a Stipulation of Dismissal ready to go. A fellow board member pointed me to http://www.prosefights.org/nmlegal/jsccomp...tbrownscott.htm

and this shows the rule for a Stip. of dis. without prejudice, how would I go about finding the rule that sites a Stip of Dis with prejudice? Today I went to the court clerk who didn't know and pointed meI to Legal aid--I did contact them and they will get back to me.

Also, in wording this would I say "Pursuant to Stat. XXX (or would it be rule XXX?) and then a brief write up of the statute/ rule?

    I am in New Mexico.
