Can CA report without notice??

    I just rec'd an alert from Exp...

    A CA that I have never heard of reported a negative recently (07/06) and I was never sent a notice, or anything from them..I think I've read somewhere here that this is not legal...I've spent an hour looking thru advanced search and now my head hurts!!!

    I also noticed that they did an inquiry (05/23/06) that I obviously did not authorize since I have never heard of them!!

    The alleged OC of this item is a condo management office where I previously lived. I did not have a current signed lease, was month to month basis and moved out at the end of Nov. 05. They have not contacted me about any $$ they feel they are owed but according to my credit report the CA reports the amount of $5300!!

    I obviously will be contacting the alleged OC to ? this but what to do with the CA??

    I would write to the OC and ask for Validation of the debt.

    Since I'm new at this, someone else may be able to offer better advice.

    Did they have your new address?

    Were any other renters sharing the place with you? Did you move out, while they stayed on, leaving later with unpaid amounts due? That could complicate it.

    If you were month-to-month, and gave them any required 30 days notice, presumably this would not be for unpaid rent.

    Did you have a deposit? Did they return it? That would imply that at the time they considered your account closed with no balance due.

    If they failed to return it, or only returned part of it, or claim that damage was done for which you owe the cost of repairs, in many states, depending on state law, they may have been required to provide you with an itemized list of those costs within a certain number of days, or else the "debt" is not valid. (For example, for California, I believe it is about 21 days, after which if they haven't provided an itemized bill, they would owe you your full deposit back.)

    Regarding the CA, they can report a CA TL even if they have not contacted you. You should dispute the debt and request validation from the, in writing, CRRR. On their receipt, as confirmed by receiving back the green card or confirming on the USPS web site, you should dispute the TL thru the CRA.
