Can Capitol One do this?

    These are being reported in my ALERTS from Equifax on Truecredit.

    This is that charged off account that is due to fall off soon. Equifax never posted it all these years. In the view section it now reads "A new account has appeared on your credit report". They are all the same old account.

    I'm handling this another way but I am curious about this type of reporting.
    Certainly feels like harassment.

    Then in my 'Credit Tips' section it says Equifax reported a recent late payment. I have no late payments whatsoever and none that are posted on the reports themselves.

    It looks like either a "computer error", or a deliberate attempt to poison your credit report, if it affects your scores. It might also indicate that Cap One is in the process of offering to sell a portfolio of bad debt, and the inquiries were originaly part of determining the value of the portfolio, but they are screwing up the process generating multiple inquiries.

    The next question is how to best deal with it. You would want to document it via direct paper credit reports from Equifax, with matching FICO scores, to ensure, and be able to prove, that it is not an artifact created by Truecredit but is actually on Equifax's reports, and that it is having an excessively damaging effect on your scores.

    Are these "accounts" visible to others?
    Are they affecting your FICO scores?

    When did the account originally go delinquent?
    How long before it must be removed by Equifax?
    Has it passed SOL in your state?

    How long before it must be removed by Equifax? 7 years
    Has it passed SOL in your state? YES


    I called Equifax and actually spoke with someone (truecredit gave me a number). Yes Capitol One IS posting a recent late payment on the charged off account. Equifax said the reason there are so many alerts and notices of "New account posted" is due to my inquiries disputing this account the past few weeks.

    So when I initially disputed on all three reports....that was 3
    And when I reinvestigated through TransUnion and Equifax... that was 2.

    BUT They ALL became posted to Equifax. 5 Alerts. All stating a 'new account is posted'.

    So now Equifax took the dispute on the phone for the reporting and I can expect another alert I guess too.

    Well Capitol One has done it again. They posted a repeat "NEW ACCOUNT POSTED" for the same old account with Equifax. Can this be an auto response for disputing? The same 'new account posted' 6 times still feels like harassment.

    The Equifax FAKO score on Truecredit is dropping.

    Is there a law or code I can cite to cease them from doing this? How can they report a late payment when there has been no activity on this account for 6 1/2 years?

    I am dealing with this account from another direction now but this might work to my advantage in court if it ends up I have to sue.

    You need to pull direct CRA reports to see for sure what is literally on your reports, and if necessary, to have evidence usable to show damaging information is being posted. A report thru Truecredit, or any third party, even if associated with a CRA, may not be enough.
