A bit of info is needed here. Here's the deal, I disputed the last remaining stain on my CR from my divorce (ex's CC that was charged off). Dispute was made on or about 29NOV06. On 29DEC06 I rec'd notification from Experian that the disputed item was removed from my CR. Good for me right? On 04FEB07 I receive a fresh copy of my CR dated 28JAN07 stating that they, Experian, received info from the CC company and decides to update my CR and returning the negative item to my report. What's wrong with this picture?? Please help, John ETA: I failed to mention that this item was disputed and was removed from TransUnion and Equifax reports.
Experian is required by law (under the FCRA) to "notify you in writing prior to reinsertion of any negative reporting before ading it to your credit report. You will have to request in writing (send request Certified Mail Return Receipt Requested) for the EXACT dates of when this additonal information was received, and request the copy of the information. Based on the dates given, both the CC issuer and Experian have violated the reporting laws of the FCRA. You should first read the Fair Credit Reporting Act (available on the FTC website) so you are familar with the requirements. Then send appropriate requests for removal. In summary, no they cannot do this, and you have a strong case for removal.
