My husband is nervous about talking to a CA that has started calling because I have been doing all of the credit repair research. He thinks he might say something that would be bad, or agree to something bad in our process of trying to get a settlement. I gave him talking points, but he still doesn't want to do it. In a way, I think it might work to our advantage -- He could play the poor put-upon, unknowing husband. "My wife says I can't agree to anything. My wife has said we HAVE to get it in writing. My wife has said we only have $X to pay for this." Not that its like that, but maybe it would help ... Or can I just call them for him? thanking in advance. peace, delilah
Delilah, I have always had good luck calling on behalf of hubby on just about anything but with the credit card companies, and the satellite service. I put him on the phone "yes talk to my wife, she handles everything". I generally start out with, its his stuff, but he is clueless when it comes to xyz, I always handle all that. All the CRA's let me handle his reports LOL. The bigger question is, do you really want to talk to a CA on the phone? You really want to get everything in writing. I'm sure they would be willing to talk to you, or anybody else, if they think they might get paid LOL! Although I believe its an FDCPA violation.
It is always recommended to have everything done in writing. A CA will lie to you on the phone, and make several promises it has no intention of keeping. That is why it is always recommended to get it in writing. That way when they dont follow through with what they said they will do. You have some type of recourse.. That being the written statement from the CA.. So if you follow this line of thinking whom does the actual work on this account at your home wont matter since it is all done in writing. If you prefer to call.. Unless your listed on the account. I would think they should not be allowed to talk to you. Not saying the wouldnt.. As being married or divorced impacts the contract your husband sign in no way. As a lot of people have found out here through going through divorce and getting a judge to say.. this bill is yours and then they dont pay.. your name is on the account.. and the negative info goes on your report as well.. Even with the order from the court for the husband to pay. The OC or CA wont give two hoots about..
I think it works this way in every household.. Us men, get too excited on the phone.. and get frustrated.. and hand the phone to the mrs.. lol Goodness we must have some redeeming qualities about us.. If you think of any email me.. hehehe I think jodi is right although they may not be or should not be talking to you.. I think a majority of them will.. especially if it is a woman on the other end of the phone.. Since it is pretty much a given us men.. well the majority are pretty useless in this aspect of life..lol

You should see us fighting for the phone when a CA calls. He THINKS he's going to help me, and he's like Delilah's DH, he hasn't spent a moment on on this credit stuff.

Yes I will be getting something special this Valentines Day.. Even though it should probably be a new house for all she has to put up with from me.. She will have to settle for a painting of her favorite photo from our wedding.. and a nice dinner in the city

Sometimes, I DO get frustrated when he talks to them...only because I know what all the conversations & correspondence relate to and he doesn't. It isn't his fault at all...it's like walking into the middle of a movie and trying to know what is going on.
OMG are you telling me its not him, its men in general!!!!!!! I hate that one, because I can't hear what is being said on the other end, and then he gets mad at me...especially if I know its a question that shouldn't be asked!

ummm.. Nope its just him...lmao.. okay okay.. I admit I do it.. From everything from her ordering a pizza, to calling the phone company to argue a bill.. latest one was having her call to argue the latest homeowners insurance bill.. She got so mad at me, she handed me the phone and went outside.. Had to tell them she will call them right back.. The I proceeded to explain to her.. Its not my fault.. its the way god made me..lol

But about talking to CA's on behalf of DH, you shouldn't have **any problems**. CA's have always talked to me without any permission from dh. It also does say somewhere in the FDCPA creditors talking to spouses are generally exempt from punishment.
