I have a paid CA account that once belonged to the elec.company. On my report it says paid, it was for 36.00 I did pay the elec company instead of collection agency. I have since sent validation to the CA and they haven't responded-just fired out the estoppel two days ago. I am gettting ready to file lawsuit in my county. My question is this- will I have a case being that the account has been paid? I sent the letters no response from them, I then disputed with CRA and they verified it. I have them on a couple of things, but Im just not sure if I have a case based on the account being paid. Please help.
If the listing is from the CA and not the elec company, then YES you have a case. The CA can not report information on a debt that it can not validate. You are not claiming the account was NOT paid, you are claiming that the CA continues to verify information to the CRA without responding to your validation requests and providing the necessary proof. Did you send CRRR and do you have green cards for the receipt of the validation and estopple? -Peace, Dave
Yes, I have sent all letters through CCCR. I am really eager to get these guys here is what I got them on. 1.Notice acct on report and call them to get explanation, they respond by asking me why I was looking at my credit report and was I planning on buying a house or something. 2.Sent letter validation 1 with no response. 3.30 days later validation#2, no response. 4.Dispute with CRA and they verify it, still havn't validated it yet.. 5.sent estopell waiting 10 more days and then Im filing. Is it an additional penalty for each CRA they verify with while in dispute?
