I got this letter last month. From: Slimeball Attorney Collector wannabee Re: Our Client: CREDITRUST CORP Acct: xxxx xxxxxxx xxxx Principal: $8,135.04 Interest: $11,568.25 Amount due: $19,703.29 Dear (Tamberlee) Our records indicate that you have failed to respond or otherwise fully resolve the above referenced matter pursuant to this office's initial demand letter. It is necessary for you to satisfy your debt owed to our client as specified above immediately. You must mail your payment today or call our offices at the telephone number printed above to make such arrangements. Pleased be advised that our client reserves all of its lawful rights and remedies necessary to collect this debt. This communication is from a law office acting as a debt collector and is an attempt to collect a debt on behalf of CREDITRUST CORPORATION. Any information obtained wil be used for that purpose. Very truly yours, Slimeball pissant Collection Department Manager Slimeball Law Firm, P.C. Now, my thoughts: This is from an old Amex I let go after a divorce in 1996. Dola around 4/1996. (Colorado SOL 6 years), color it gone! Long off my credit report. Now I know I can send them an C&D and sol **** off letter. Last month I sent them a validation letter because I knew they wouldn't be able to. Shoot, Creditrust couldnt 4 years ago. And I know Creditrust is long gone. I look at this as a scam as Creditrust Corp can't possibly be their client, can they??? Creditrust is gone. 1.) So while I know this Law firm is trying to make a buck from those who will pay them, I want to fight back. This trying to collect for a SOL debt from a BK'd client is deceptive trade practice, right? 2.) This attny collection letter was missing the required statement that the State of Colorado requires. Could be a violation. 3.) This firm (2 miles from my house)(specializing in debt collection) is not licensed with the state's collection agency board. Possibly trouble there. Any ideas what to do with these schmucks??? Thanks.
I guess if they were just a CA, I'd take a pro se run at them. But seeing how they do have a few attorneys over there on staff (I checked the firm pretty hard), I'm a bit reticent if not intimidated. I wish I knew an attorney in CO that likes to sue other attorneys. Probably not worth much money to go after I suppose.
Well, if it were mine I'd probably file a small claims case for $1,000, or so. And then agree to drop it for half. It'd be great practice for ya. .
That's not necessarily true. Bankruptcy attorneys LOVE these types of cases. Check the Yellow Pages out there and make a few calls. If you have this CA on enough violations, you'll find an attorney who will bite. And no, I don't think it matters that you're not a bankruptcy client.
